Bagh Singh [Torture, Extra-judicial killing]<br />

Case Information<br />

FIR no. 56/1993 under Section 302 [murder] Ranbir<br />

Penal Code [RPC] dated 9 November 1993 was led<br />

at the Panzalla Police Station. The FIR states that on<br />

19 October 1993 the victim and his wife went to Deva<br />

Singhs house. On return, the BSF were on the road<br />

and asking people to get down and checking cards.<br />

Bagh Singh told them his name and that he was<br />

retired army havaldar. He was then taken with them in<br />

a gypsy. The others were asked to wait there. On 20<br />

October 1993 the body was at Baramulla police<br />

station. He had been tortured to death.<br />

Information was sought on this FIR through RTI<br />

dated 14 November 2014. By communication dated<br />

5 January 2015 from the Jammu and Kashmir<br />

Police a copy of the FIR and chargesheet were<br />

provided. The chargesheet is dated 5 May 2001.<br />

By communication dated 8 November 2000, Ministry<br />

of Home Affairs informed the Government of Jammu<br />

and Kashmir that sanction for prosecution under<br />

AFSPA was granted for the alleged perpetrator, who<br />

at the time of the communication, in November 2000,<br />

was serving a 15 year imprisonment [rigorous]<br />

following a conviction by the Special Court, NDPS,<br />

Bikaner, Rajasthan under the NDPS Act. It appears<br />

that in the communication from the Government of<br />

Jammu and Kashmir, the name of the alleged<br />

perpetrator was wrongly noted as “Ravinder Singh”.<br />

This appears therefore to be a case where sanction<br />

for prosecution was granted. Yet, the government of<br />

Jammu and Kashmir does not appear to have any<br />

record of this as it maintains that there has been no<br />

case in which sanction has been granted. Also, it<br />

needs to be ascertained whether the alleged<br />

perpetrator was actually then tried by a civilian court in<br />

Jammu and Kashmir.<br />

On 5 November 2014, the IPTK researchers met with<br />

the wife of the victim to record her testimony on this<br />

case. She refused to provide any testimony to the<br />

IPTK.<br />
