Case Information<br />

On 16 May1995, while Mohammad Yousuf Malik, an<br />

employee of the government Fisheries department,<br />

was working in his paddy elds, located near a huge<br />

Chinar Tree in the village of Brar, Bandipora his<br />

residence in Chiti Bandey [located about 5 kms away]<br />

was raided by members of the local Ikhwan group,<br />

headed by Shabir So [nephew of notorious Ikhwan<br />

Kuka Parray]. An Ikhwan named Shahnawaz<br />

[Resident of Ajas] had recently been killed by<br />

militants, and the victim's house was raided by the<br />

local Ikhwan group in this regard.<br />

Shabir So, commander of the group, Sattar So [Son<br />

of Mukhtar So], Nazir So [Son of Ahad So],<br />

Mansoor So [Son of Kamal So] and Sultan Ganai<br />

[Son of Lassi Ganai] all residents of Brar, who were<br />

known to be working for the army's 13 Rashtriya Ries<br />

[RR] camp in Brar were involved in the incident. On<br />

failing to nd the victim at home, and after questioning<br />

his family members, they headed towards the paddy<br />

eld in search of him. They met the victim, who was<br />

carrying his son Bilal on his shoulders, on the main<br />

road and assaulted him. They snatched the child, and<br />

threw him on the road. Thereafter they began<br />

dragging the victim barefooted towards the Ikhwan<br />

headquarters located in the residence of Shabir So.<br />

The victim's wife Dilshada, and his two sisters<br />

Haneefa Bano and Rosha Bano were eye-witnesses<br />

to this. They gathered around and begged the<br />

Ikhwans to release him, but the Ikhwans red shots at<br />

them, and did not allow them or his other family<br />

members to follow them. No one else dared to come<br />

forward to help them as this incident was taking place,<br />

though there were several witnesses.<br />

Immediately thereafter, the family approached the<br />

head of the Ikhwans in the area, Usman Majid,<br />

resident of Garoora. They were informed that Usman<br />

Majid was not at his residence [also an Ikhwan Camp]<br />

though they suspected that he was avoiding meeting<br />

them. Finally at about 11 pm, Ghulam, Nabi brother of<br />

Usman Majid told the family to search for him at the<br />

camp of Javaid Shah, another local Ikhwan.<br />

On next day 17 May 1995, the victim's wife Dilshada,<br />

his mother Misra Begum, and his grand-father tried to<br />

approach Javaid Shah [Son of Sikandar Shah,<br />

Resident of Nadihal] at his residence which was also<br />

an Ikhwan camp. At rst they were obstructed by other<br />

Ikhwans present at the camp, but after a prolonged<br />

wait and much insistence they were nally allowed to<br />

meet him. The victim's wife Dilshada appealed to him<br />

to release her husband. Javaid Shah assured her<br />

that the victim would be back at home by 4:00 pm, the<br />

same day. The family was convinced that the victim<br />

would be released soon, and they began the return<br />

journey. However, on their way back home, at Gujjar<br />

Bastie, a sherwoman met the family and told them<br />

that Mohammad Yousuf had been killed and his dead<br />

body had been found at Sangree colony, Wular Top.<br />

The family refused to believe her. But when they<br />

reached their home they found the dead body of the<br />

victim lying on the ground outside the house. There<br />

were severe torture marks visible on his body. There<br />

were widespread local protests against the Ikhwans<br />

after his death. His dead body was buried in his<br />

ancestral graveyard at Malik Pora.<br />

The wife of the victim Dilshada Begum, gave the<br />

above statement to IPTK on 1 May 2015.<br />

The eye-witness statement is clear, and cogent<br />

evidence is presented of the torture and killing by the<br />

alleged perpetrators. The allegations warrant further<br />

investigation. In addition, the role of the 13 RR at Brar<br />

camp in this killing, even under the international<br />

criminal law principles of command responsibility<br />

would need to be analyzed and further investigations<br />

are warranted.<br />

was playing in his school compound when Ayoub<br />

Wagay, Fayaz Ahmad Dar and Ghulam Mohammad<br />
