507 | Structures of Violence<br />

In the camp, Sham Commander asked the victim<br />

about the action against CRPF which they had<br />

undertaken together and forced the victim to admit<br />

that he was a militant. After this, Subedar Sujan Singh,<br />

along with his personnel, tortured the victim. The<br />

victim's body was electrocuted along with his private<br />

parts. The victim was beaten with a rope and a roller<br />

was rolled over his body. The legs of the victim were<br />

also stretched. Many army personnel trampled his<br />

body. This torture continued for 2-3 hours. When the<br />

victim asked for water, Sujan Singh urinated in front of<br />

him and asked the victim to drink it. After two days, the<br />

family of the victim approached the camp and<br />

requested them for his release. Then he was<br />

released.<br />

After the release, Sujan Singh continued to harass the<br />

victim and wherever he would see him he would ask<br />

him where he was and sometimes slap him also.<br />

Sujan Singh visited the school of the victim many<br />

times to check whether he was in his school only or<br />

not.<br />

After 5-6 months, Sujan Singh picked up the victim<br />

again for no reason and took him to Khanabal Camp.<br />

R.S. Kataria [probably Lieutenant Colonel] was also<br />

with Sujan Singh when they picked the victim up. A<br />

renegade “Vitt Ganai”, resident of Malakhnag, had<br />

informed the army that the victim used to be with the<br />

militants. This time the victim was tortured the entire<br />

day – his body was rolled for hours and his body and<br />

private parts were electrocuted. His legs were also<br />

stretched. This time the victim was kept for one day<br />

only and was released in the evening.<br />

Yet, even then Sujan Singh remained after him. Once,<br />

he told the victim to work for him. The victim refused.<br />

Sujan Singh told him that he would arrest him. The<br />

victim replied that if he had any evidence against him<br />

of being a militant then he could arrest him. This<br />

harassment, including raiding the house, stopping on<br />

the road, continued till 2005, after which it stopped.<br />

The victim, Shuja Hussain Raqui, gave the above<br />

statement to the IPTK on 9 May 2015.<br />

The victim's statement is clear, and cogent evidence<br />

is presented of the torture by the alleged perpetrators.<br />

The allegations warrant further investigation. The role<br />

of both the Ikhwan appears to be only in terms of<br />

providing information to the army and in that sense<br />

their responsibility would not be the same as the army<br />

ofcials.<br />

1. Major Gurpal Singh, Nowgam Camp<br />

Case Information<br />

In April 1993, the army of the Nowgam Camp [victim<br />

does not know the battalion] arrested the victim. The<br />

victim was associated with the Muslim Janbaaz<br />

Force. Major Gurpal Singh tortured him. He was<br />

detained for two years and ve months. He was<br />

arrested at Nowgam; from there, he was shifted to Kot<br />

Bhalwal Jail. He was beaten with steel rods and<br />

wooden batons. His legs were stretched and he was<br />

forced to overdrink water. A roller was also rolled on<br />

his body. His head was dipped in a mixture of water<br />

and chilly powder. He was kept naked. The detainees<br />

were provided some medical help but the medical<br />

assistance was only a namesake. His relatives were<br />

allowed to meet him after two to three months. The<br />

victim was not tortured at Kot Bhalwal.<br />

Everyone knew Major Gurpal Singh, as he was very<br />

notorious because of how oppressive he was. Gurpal<br />

Singh tortured the victim at Nowgam camp. He gave<br />

electric shocks to the victim in the head about 10<br />

times. The detainees were tortured for ve<br />

consecutive days in the morning and evening. Each<br />

time, he was tortured for about half an hour.<br />

The victim's family members were arrested and<br />

tortured. The army and other security agencies also<br />

wanted his brother to trace his whereabouts. The<br />

victim still needs medical help because he was<br />

severely tortured. His livelihood has sustained<br />

setbacks because he can't work or earn. He suffers<br />

general weakness. For the last one year, the army<br />

does not call him as frequently as earlier. He is<br />

supposed to report to the camp on some special<br />

occasions such as Independence Day or Republic<br />

Day or whenever any militant activity takes place.<br />

The victim, Abdul Rashid Pandit, gave the above<br />

statement to the IPTK on20October 2014.<br />

The victim's statement is clear, and cogent evidence<br />

is presented of the torture by the alleged perpetrator.<br />

The allegations warrant further investigation.<br />
