Case Information<br />
In 1990, the brother of the victim Raq Ahmad Tantray<br />
went across the line to join the militancy movement.<br />
Since then, the army had been harassing the family<br />
and the victim.<br />
The army of the Hamray camp raided their house<br />
many times and enquired about the brother. Since<br />
1995, the victim was forced to appear in the army<br />
camps at Palhallan, Wusan and SOG Camp Baba<br />
Taing every Sunday. Intelligence Bureau ofcers<br />
Bishnu Pandey and Verghese also called the victim to<br />
Hyderbaig camp. At the camp, the victim came to know<br />
about the name of these ofcers.<br />
Since 1998, the victim and other persons of the village<br />
[anyone whose family members were militants] were<br />
forcibly kept in the camp for a night and made to sleep<br />
there. Then in the morning, the victim and others were<br />
made to sweep the camp and only then were they<br />
allowed to leave. This continued till 2001.<br />
In 2002, at about 9:30 am, the victim was at the shop of<br />
his maternal uncle Ghulam Mohammad Bhat.<br />
Meanwhile, two government gunmen Mohammad<br />
Abdullah Yatoo and Reyaz Sadda passed through the<br />
same road where the shop was situated. There was<br />
also an army camp in the Pandit houses then. One of<br />
them, Mohammad Abdullah Yatoo, was shot on his<br />
head. Nobody could nd out where from the bullet was<br />
red. Then the army also red in the air. The victim and<br />
the uncle ran away from the spot and hid themselves at<br />
Kumar Mohalla. The army raided the same place<br />
where the victim and the uncle were hiding. They were<br />
arrested and brought to the spot of incident again.<br />
There the Deputy Superintendent of Police [DSP]<br />
Operations Rashid Billa grabbed the ear of the victim<br />
and asked him about the killing. Then both the victim<br />
and uncle were taken to Palhallan Camp and were<br />
kept there for 5-6 days before being released.<br />
On the night they were released, at about 11:30 pm,<br />
the SOG of Baramulla raided the house of the victim.<br />
The victim was taken to G-Branch, Matches Factory,<br />
Baramulla. For rst 1-2 days, no torture was done.<br />
After 2 days, the victim was tied to a chair and was<br />
beaten by sticks. SP Operations Mushtaq Sadiq would<br />
beat the victim himself. After beating him, the victim<br />
was electrocuted. When the victim was going out to the<br />
bathroom, SOG personnel beat him till he reached the<br />
bathroom. The victim was released after 16 days and<br />
torture was done to the victim on and off during these<br />
days. Then the victim was brought to police station<br />
Pattan for 5-6 days and was released then.<br />
On the same day when the victim was released, SP<br />
Mushtaq Sadiq was going on a raid to Shalpora,<br />
Palhallan. When he reached Palhallan, he sent the<br />
watchman of the area to call the victim. The SP took<br />
the victim along for the raid. On returning from there,<br />
the SP handed over the victim to Police Station Pattan<br />
and the victim was kept there for 2 days.<br />
On 15 August 2002, the victim and other inhabitants of<br />
Palhallan were forced to hoist Indian Flags on their<br />
shops and houses by the army of Wattergam. Major<br />
Rakesh was along with the army. The Major noticed<br />
that the ag hoisted on the shop of victim's maternal<br />
uncle was not correct. He asked the victim who had<br />
hoisted the ag and told him to bring the ag down. The<br />
victim tried to bring the ag down but he couldn't reach<br />
the height of the ag. The Major abused the victim<br />
verbally and scolded him to bring it down. The victim<br />
jumped and brought the ag down, but the ag fall<br />
down on the road. So the army beat the victim with<br />
sticks, and Major Rakesh slapped the victim 10-15<br />
times. He was trampled by the army and dragged on<br />
the road.<br />
In 2003, the victim was going to his ofce to Sopore in a<br />
bus, but he noticed that he was being followed by a<br />
sumo [the sumo was stopping where the bus stopped<br />
and was trailing the bus till Sopore]. At Sopore, when<br />
the victim alighted from the bus, four boys came out of<br />
the sumo and asked the victim about Huda College;<br />
the victim replied that it was in Pattan. All the four boys<br />
were non-Kashmiris; the victim identied this by their<br />
language and look. The boys took out a pistol and<br />
forced the victim to get into the sumo. They covered<br />
the eyes of the victim and after driving around for 2-3<br />
hours, kept the victim in a water tank, which was in an<br />
army camp. The victim feels that he was kept in Choor<br />
Camp, as there was a water tank in Choor Camp. The<br />
tank was almost 50 meters deep. The victim was<br />
brought down using a ladder. On the rst day in the<br />
tank, the victim was made to drink chili powder water<br />
and was not allowed to sleep, as a bright lamp was<br />
kept on in the tank, which was pointed towards his<br />
face. The victim was kept there for seven days and for<br />
this period the victim was not allowed to sleep.<br />
After this, the victim was referred to Sharifabad camp<br />
for seven days. At both the places, the victim was<br />
asked about his brother's whereabouts. On the<br />
seventh day at Sharifabad camp, an army ofcer told<br />
him that he would be killed the next day. He was told<br />
that his parents would receive a message tomorrow<br />
that their son had been killed while crossing the border.<br />
The victim doesn't know the name of the army person<br />
who said this to victim. On the same night, the victim<br />
was brought to Narbal with his eyes covered at about<br />
12:30 am and was tied there with a tree. Some army<br />
person told the victim that he was going to shoot him<br />
and he asked the victim where he would like to be shot.<br />
The victim replied on the heart. The army left the victim<br />
there, but the victim wasn't aware about it as his eyes<br />
were covered. He was under the threat that he would
