Case Information<br />

Reyaz Ahmad Dar was a militant belonging to the<br />

Hizbul Mujahedeen. He had trained in Pakistan. After<br />

his death, his family, consisting his brother and his<br />

wife, were harassed by the Ikhwan.<br />

Ikhwans headed by Bashir Yaar, accompanied by<br />

other Ikhwan – Ama Chacha, Bashir Gagur; and<br />

Mehdeen Pitch, along with Sul Karnayee and Rehman<br />

Chabee [who did not have any weapons but was<br />

working for the Ikhwans] – always found a reason to<br />

search their house and torture them. These atrocities<br />

continued for four to ve years.<br />

On 4 May 1995, when the victim was returning home,<br />

he was surrounded by the above-mentioned Ikhwans<br />

and red at. At least thirty bullets were shot at him. As<br />

soon as the family [Rafeeqa [wife], M. Jabbar Dar<br />

[Uncle], Azi [Mother] and Saleema [Sister] reached the<br />

place where the incident occurred, Mohammed Akbar<br />

Dar was rushed to the hospital at Hajin. But he died on<br />

the way. After performing the last rituals, he was buried<br />

in his local graveyard.<br />

The wife of the victim, Rafeeqa Begum, gave the<br />

above statement to the IPTK on 29 May 2015.<br />

The witness statement is clear, and cogent evidence is<br />

presented of the killing of the victim. But, the actual<br />

attack on the victim needs to be investigated further<br />

and further details need to be collected.<br />

Case No. 59<br />

Nisar Ahmad Pencha [Abduction, Torture, Extrajudicial<br />

Killing]<br />

Occupation: Tenth Grade Student<br />

Son of: Ghulam Mohammad Pencho<br />

Resident of: Kulhama, District Bandipora<br />

Alleged Perpetrators<br />

1. Amma Kol, alias Cobra, Government<br />

Gunman [Ikhwan]<br />

Case Information<br />

On the intervening night of 5/6 May 1995, at about 3:00<br />

am someone knocked on the door of Nisar Ahmad<br />

Pencho's house. His mother, Khatija Begum<br />

recognized the person, Shahnaz Ahmad Pencho their<br />

next door neighbor. As soon as she opened the door,<br />

however ve gun men dressed in civilian clothes with<br />

their faces covered with a black cloth, entered the<br />

house. She recognized one of the gunmen, Amma Kol,<br />

a resident of their village.<br />

The gunmen searched all the rooms in the house and<br />

nally dragged the victim and his brother, Abdul Majid<br />

Pencho out of their house. Their grandfather pleaded<br />

with the gunmen, to let the boys go, but Amma Kol<br />

refused. Nobody came to help the family due to the<br />

widespread fear of the Ikhwan in the area. On the<br />

same night, another young boy was abducted by<br />

Ikhwans in the nearby village of Kulhama. When they<br />

reached Garoora, the two boys – Majid and Nisar were<br />

separated, and Nisar was taken on a different route,<br />

according to Majid who was a witness to events up to<br />

this point. Majid was allowed to return to the family.<br />

On the next morning, Zooni Begum a sher woman<br />

came to the house and told Nisar Ahmed's mother that<br />

her son had been killed and his dead body was lying at<br />

Sangree Top, near Garoora. On the same day, the<br />

other kidnapped boy was also killed by gunmen<br />

afliated to the same group of Ikhwans. It was widely<br />

believed locally that both boys had been killed at<br />

Javaid Shah's house [Ikhwan Camp] at Nadihal. That<br />

day the two dead bodies were brought to the village of<br />

Kulhama. Nisar Ahmed's dead body bore marks of<br />

torture. There were also about ve bullet wounds on<br />

his body. This was the third death in their family. First,<br />

an older son Gowhar Ahmad, who was a well known<br />

militant was was killed in an encounter with the Indian<br />

Army, then her husband was killed by the Ikhwans and<br />

lastly her 16 year old son was killed.<br />

The mother of the victim, Khatija Begum, gave the<br />

above statement to the IPTK on 22 June 2015.<br />

The witness statement provides evidence of the<br />

abduction, torture and killing by the alleged<br />

perpetrators. The eye-witness testimony of Abdul<br />

Majid Pencho in this case would need to be recorded.<br />

The allegations warrant further investigation.<br />
