Case Information<br />

Ghulam Mohammad Pencho, a sherman by<br />

profession, had eight children, four sons and four<br />

daughters. One of his sons, Gowhar, was an active<br />

militant with Hizbul Mujahideen and was known as<br />

“King of Wular'”. On 14 October 1994 he was killed in<br />

an encounter at Boniyar. After Gowhar's death<br />

Ikhwans raided the victim's house many times. During<br />

one of these raids, the victim's sister was tortured<br />

severely for several hours.<br />

On 3 August, 1995 while collecting sand from the river<br />

at Kulhama, Ghulam Mohammad Pencho was<br />

attacked by a group of Ikhwans as named above<br />

[alleged perpetrators 1-4]. A local sher woman was<br />

an eye-witness to the attack. The victim managed to<br />

escape detection by submerging himself under water.<br />

However, the Ikhwans continued to search the area<br />

and found him after about an hour. The group of<br />

Ikhwans stripped him naked and began torturing him<br />

on the spot. He was then taken to the Ikhwan<br />

Headquarters at Nadihal, located in the residence of<br />

Javaid Shah. Top Ikhwan Commanders like Usman<br />

Majeed, Javaid Shah, Mir Niyaz, Shaq Pandith,<br />

Bashir Khan, Ghulam Hassan Qureshi frequently<br />

operated from this camp.<br />

On learning about his torture and abduction, Ghulam<br />

Mohammad Pencha's daughter along with other<br />

villagers marched in a procession into the Nadihal<br />

Ikhwan Camp and demanded that the Ikhwan<br />

commanders namely Usman Majeed and Javaid<br />

Shah order Ghulam Mohammad's immediate release.<br />

The Ikhwans in the camp premises, red in the air to<br />

disperse the crowd, but the villagers refused to budge<br />

and forcibly dragged the half dead Ghulam<br />

Mohammad out of the camp to a boat nearby. He was<br />

in great pain and his body bore marks of torture. His<br />

kidneys, lungs, head and legs appeared to be most<br />

severely damaged. He succumbed to his injuries.<br />

The wife of the victim, Khatija Begum, gave the above<br />

statement to the IPTK on 21 June 2015.<br />

The witness statement provides evidence of the<br />

torture and killing by the alleged perpetrators. The<br />

eye-witness testimony in this case would need to be<br />

recorded. The allegations warrant further<br />

investigation.<br />

Case Information<br />

On 21 August 1995 evening, the victim was at home<br />

when the Ikhwan came. The Ikhwan were Rashid<br />

Bucha, resident of Shilwat, Ali Kulloo, resident of<br />

Dempora, Sumbal, Manzoor Nabdi, Fayaz Ahmad Mir<br />

alias Fayaz Nabdi, and Sha. They caught the victim,<br />

and dragged him out and took him to the house of a<br />

migrant Pandit Janki Nath, where the head of Ikhwan,<br />

Ghulam Mohiuddin Kana was present. Within half an<br />

hour, the victim was killed. There were no bullet marks<br />

on his body but there were some torture marks on the<br />

victim's body. Then there was a huge protest against<br />

the Ikhwans. The Ikhwans told the family of the victim<br />

to take the victim's dead body otherwise they would<br />

burn it.<br />

The wife of the victim, Ashia Begum, gave the above<br />

statement to the IPTK on 24 April 2015.<br />

The witness statement is clear, and cogent evidence<br />

is presented of the killing of the victim. Ashia Begum is<br />

an eye-witness and her statement carries great<br />

weight. The allegations warrant further investigation<br />
