Baramulla submission that non-subversion/civil<br />

c o m m o t i o n c a s e s c o u l d n o t b e g r a n t e d<br />

compassionate employment is erroneous. Both the<br />

SHRC and the DC, Baramulla have ignored the fact<br />

that a crime of extra-judicial killing was perpetrated.<br />

Extra-judicial killings under International law or the<br />

local laws are clearly a despicable human rights abuse<br />

and the classication of these extra-judicial killings into<br />

civil commotion or militancy related incidents does not<br />

change the nature of the crime perpetrated. Also this<br />

classication of extra-judicial killings into militancy<br />

related and non-militancy related amounts to be<br />

discriminatory, which is in violation of Article 14 of<br />

Indian Constitution and also the Jammu and Kashmir<br />

Constitution.<br />

Despite the enquiry report of the Additional District<br />

Development Commissioner, Baramulla conrming<br />

that an extra-judicial killing took place, no FIR on the<br />

killing of Mansoor Ali Kumar was led. Further, the<br />

Jammu and Kashmir Police continued to falsely<br />

represent the facts of the case before the SHRC. The<br />

conduct of the Government of Jammu and Kashmir in<br />

this case helps in understanding the practice of<br />

appointing enquiries after human rights abuses and<br />

the non-implementation of the enquiry reports.<br />

Case Information<br />

On 13 December 2008 a procession against the then<br />

ongoing Jammu and Kashmir State Legislative<br />

Assembly elections was taking place in the area.<br />

Muzaffar Mushtaq Ganaie, a student preparing for his<br />

exams, was not a part of the protest. A group of CRPF<br />

personnel came to the village and without any<br />

provocation red upon the crowd. Muzaffar Mushtaq<br />

Ganaie, standing on the side, was targeted and was<br />

critically injured and rushed to the Pulwama hospital<br />

and then to the Shri Maharaja Hari Singh Hospital<br />

[SMHS], Srinagar. On the way to Srinagar, the<br />

ambulance carrying the victim was stopped by the<br />

CRPF at Kakpora for about one hour. The victim<br />

succumbed to his injuries on the way to the hospital.<br />

Muhammad Ayub Kumar and Zeeshan Ali Bhat were<br />

injured in the ring as well.<br />

A First Information Report [FIR] was led at the<br />

Pulwama Police Station. The Government of Jammu<br />

and Kashmir ordered an enquiry with Khursheed<br />

Ahmad Ganai appointed as the enquiry ofcer. The<br />

family of Muzaffar Mushtaq Ganaie testied before<br />

the enquiry. According to media sources, on 21<br />

February 2009, Deputy Commandant of the 78<br />

Batallion CRPF and his PSO's were found guilty of<br />

“misconduct” for visiting the area without informing<br />

the police .<br />

It is unclear why the information regarding the enquiry<br />

report shared with the media did not carry the names of<br />

the perpetrators of the crime. Further, the nding of<br />

“misconduct” for a crime of murder is clearly<br />

misplaced.<br />

Information was sought on 12 January 2012 through<br />

the Jammu and Kashmir Right to Information Act, 2009<br />

[RTI] on all the enquiries ordered by the Government<br />

of Jammu and Kashmir from 1990 to 2011 in Jammu<br />

and Kashmir. No information on this case was<br />

provided. In the instant case the lack of transparency<br />

and accountability is a worrying factor for the<br />

deliverance of justice. Further, it needs to be examined<br />

whether the enquiry report resulted into investigations<br />

and prosecutions.<br />

The family of Muzaffar Mushtaq Ganaie was offered<br />

Rs.1,00,000 ex-gratia government relief but they<br />

refused.<br />

The family of Muzaffar Mushtaq Ganaie gave a<br />

statement to the IPTK on 16 February 2012.<br />

Further, the IPTK sought information on 10 January<br />

2012 on all inquiries and Court-Martials conducted by<br />

the CRPF between 1990 and 2011 in Jammu and<br />

Kashmir. No information was provided.<br />

The IPTK also sought information on 10 January 2012<br />

on all cases of sanctions for prosecution under the<br />

Armed Forces (Jammu and Kashmir) Special Powers<br />

Act, 1990 [AFSPA] relating to the Ministry of Home<br />

Affairs between 1990 and 2011 in Jammu and<br />

Kashmir. No information was provided.<br />
