water mixed with chemicals. Due to the torture, Ashiq<br />

Hussain Zargar's stomach was badly affected and the<br />

right side of his body was partly paralyzed and his jaw<br />

bone has also been badly affected.<br />

They were only released subsequently.<br />

Ashiq Hussain Zargar gave a statement to the IPTK<br />

on 9 January 2015.<br />

The above statement, given by one of the victims<br />

indicts SP Zahid Malik. The statement is not detailed<br />

as neither does it describe the torture in detail nor the<br />

full role played by SP Zahid Malik in the torture – but<br />

there is clear mention that he ordered his escorts to<br />

tortured the two victims. This is prima facie evidence<br />

of the involvement of SP Zahid Malik in the crime of<br />

torture. It appears no FIR was led by the victim but<br />

investigations could lead to an indictment against SP<br />

Zahid Malik.<br />

Case Information<br />

CRPF personnel from the SICOP Camp picked up the<br />

victim. The victim does not remember the particular<br />

battalion or the date on which he was picked up by the<br />

CRPF.<br />

Some personnel, namely, ofcer Raju, ofcer Sharma<br />

and Chaman Mosi picked him up from his home. He<br />

does not know whether these were their real names or<br />

not. These ofcers were notorious for their cruel<br />

nature and that is how he was able to recognize them.<br />

The victim was taken in a Gypsy to the Bus Stand at<br />

Bijbehara. He was taken off and stripped there. The<br />

above-mentioned ofcers ordered their personnel to<br />

beat him. He was beaten for 10-15 minutes, after<br />

which he was allowed to wear his clothes. He was<br />

then taken to the CRPF camp at SICOP.<br />

In the camp, the victim was stripped again and they<br />

rolled a roller on his legs and his private parts were<br />

electrocuted. Two CRPF personnel pulled his legs<br />

apart and stretched them.<br />

They accused him of being a militant. Previously, the<br />

victim's friend, Nazir Shah son of Abdul Rehman<br />

Shah, had also been taken to the same camp, and<br />

during the time he was tortured, he mentioned the<br />

victim's name as a militant.<br />

The above-mentioned three ofcers used to enter the<br />

torture cell and ask the victim about weapons. Ofcer<br />

Raju told him that if he did not give any information<br />

about weapons, he would kill him. These three ofcers<br />

never tortured the victim themselves but they would<br />

order their personnel to torture him. He was continued<br />

to be tortured on and off for 18 days. After 18 days, he<br />

was released and sent home on a stretcher.<br />

After his release, whenever there would be a militant<br />

attack in the area, he would be taken to the camp and<br />

tortured. Every time he is taken to the CRPF Camp at<br />

SICOP and tortured under the supervision of the three<br />

above-mentioned ofcers.<br />

There were allegations that his friend, Nazir Shah,<br />

was a militant and afliated to the Hizbul Mujahideen.<br />

However, the truth is that he was not; he had merely<br />

partaken in stone pelting on the streets during the<br />

protests in 2008 and in 2010.<br />

Armed forces personnel killed Nazir Shah in 2010<br />

while stone pelting. The allegation on the victim and<br />

Nazir Shah was that they were afliated with Hizbul<br />

Mujahideen.<br />

During the torture, the victim's right foot was cut by a<br />

scissor and no medical treatment was given to him. As<br />

a result, he was unable to walk even after his release.<br />

Even today, he cannot stand for a long period of time.<br />

In fact, he was released and handed over to his family<br />

only when his health really deteriorated and he was<br />

about to die.<br />

Even after his release, he is often picked up, arrested<br />

and kept in custody for 1-2 nights.<br />

The victim, Javaid Ahmad Teli, gave the above<br />

statement to the IPTK on 23 April 2015.<br />

The victim's statement is clear, and cogent evidence<br />

is presented of the torture by the alleged perpetrators.<br />

One lacuna in the statement is the fact that the<br />

witness cannot remember even the year of the<br />

incident. But, the allegations warrant further<br />

investigation.<br />
