when <strong>the</strong> Messenger <strong>of</strong> God (SAAS) prohibited people from consuming donkey<br />

meat, he also allowed <strong>the</strong>m to eat horsemeat."<br />

<strong>The</strong> provenance <strong>of</strong> this is secure in both phih collections, from a hadith <strong>of</strong><br />

HammPd b. Zayd, from CAmr b. Dinar, from <strong>Muhammad</strong> b. 'Ali, from Jabir,<br />

may God be pleased with him. He said, "At Khaybar, <strong>the</strong> Messenger <strong>of</strong> God<br />

(SAAS) prohibited eating <strong>the</strong> meat <strong>of</strong> donkeys and gave permission for horses<br />

(to be eaten)."<br />

This is <strong>the</strong> phraseology given <strong>by</strong> al-Bukhari.<br />

<strong>Ibn</strong> Ishaq stated, "'Abd Allah b. Abii Najih related to us, from Makhiil, that<br />

<strong>the</strong> <strong>Prophet</strong> (SAAS) prohibited four things that day: intercourse with pregnant<br />

women, eating domestic donkeys, eating carnivorous animals, and selling <strong>the</strong><br />

spoils <strong>of</strong> war before <strong>the</strong>ir (<strong>of</strong>ficial) allotment."<br />

This hadith is mursal, lacking proper transmission back to <strong>the</strong> <strong>Prophet</strong> (SAAS).<br />

<strong>Ibn</strong> Ishnq stated, "Yazid b. Aba Habib related to me, from Abii Marziiq, Najib's<br />

freed-man, from vanash al-SanCmi, who stated, 'We were on an expedition with<br />

Ruwayfic b. Thxbit, <strong>the</strong> an@ri, to al-Maghnb, North Africa. One <strong>of</strong> <strong>the</strong> towns<br />

<strong>the</strong>re, named Jirba, was conquered and a crier stood among us and announced,<br />

'I am telling you only what I heard <strong>the</strong> Messenger <strong>of</strong> God (SAAS) tell us at<br />

Khaybar. He stood up among us and said, "It is not permissible for a man<br />

who believes in God and <strong>the</strong> last day to mingle his sperm with that <strong>of</strong> o<strong>the</strong>rs" -<br />

referring to intercourse with pregnant captive women. "It is not permissible for<br />

a man who believes in God and <strong>the</strong> last day to have intercourse with a captive<br />

woman before determining that she is without child. It is not permissible for<br />

a man who believes in God and <strong>the</strong> last day to sell any spoils <strong>of</strong> war before its<br />

allotment. It is not permissible for a man who believes in God and <strong>the</strong> last day to<br />

ride any mount from <strong>the</strong> captured stock <strong>of</strong> <strong>the</strong> Muslims and <strong>the</strong>n to return it<br />

when it is exhausted. Nor is it permissible for a man who believes in God and <strong>the</strong><br />

last day to wear any clothing from <strong>the</strong> captured stock <strong>of</strong> <strong>the</strong> Muslims and <strong>the</strong>n<br />

to return it when it is worn out.'""<br />

Abii Da'ad narrated this similarly through <strong>Muhammad</strong> b. Ishaq. Al-Tirmidhi<br />

narrated it from Haf~ b. CAmr al-Shayb~ni, from <strong>Ibn</strong> Wahb, from Yahya b.<br />

Ayyab, from Rabi'a b. Salim, from Bishr b. 'Ubayd Allah, from Ruwayfic b.<br />

Thabit in abbreviated form. He characterized <strong>the</strong> hadith as hasan, "good".<br />

In <strong>the</strong> phih <strong>of</strong> al-Bukhm, from N%fiC, from <strong>Ibn</strong> Wmar, it is stated that<br />

<strong>the</strong> Messenger <strong>of</strong> God (SAAS) at Khaybar prohibited <strong>the</strong> meat <strong>of</strong> domestic<br />

donkeys, and also <strong>the</strong> eating <strong>of</strong> garlic.<br />

<strong>Ibn</strong> Hazm narrated, from CAli and Shurayk b. al-Hunbal, that <strong>the</strong>y accepted<br />

<strong>the</strong> prohibition <strong>of</strong> onions and raw garlic. What al-Tirmidhi transmitted from <strong>the</strong>m<br />

was that (use <strong>of</strong> <strong>the</strong>m) constituted a17karaha,M a practice considered repugnant.<br />

But God knows best.<br />
