are clean, sanitary, and properly labeled; (2) all home processed foods<br />

produced under this exemption are neither adulter<strong>at</strong>ed nor misbranded; and<br />

(3) glass containers for jams, jellies, marmalades and similar products are<br />

provided with suitable rigid metal covers. 26 This exemption is restricted to<br />

the following non­potentially hazardous home processed foods:<br />

1. Bakery products<br />

2. Traditional fruit jams, jellies, and marmalades<br />

3. Spices or herbs<br />

4. Snack items such as popcorn, caramel corn and peanut brittle<br />

5. Candy (excluding chocol<strong>at</strong>e).<br />

Also, any production of homegrown unprocessed raw produce does not<br />

require a home processing exemption. 27<br />

C. Food Wholesale in Erie County<br />

Generally, wholesale of food products is the practice of selling nondurable<br />

food items to businesses for the purpose of resale to consumers. 28<br />

Establishments within this c<strong>at</strong>egory include large­scale grocery wholesalers,<br />

packaged frozen food wholesalers, and dairy product wholesalers, among<br />

others. Examples of dairy products from wholesalers include butter, milk,<br />

cheese, ice cream and yogurt (See Figure 3.6 for a sp<strong>at</strong>ial distribution of<br />

wholesalers within the county).<br />

As of 2007, Erie County was home to 80 food wholesale<br />

establishments. The majority of these establishments (74.4%) were<br />

grocery and other rel<strong>at</strong>ed products merchant wholesalers. The remaining<br />

establishments are equally distributed within the confectionery and<br />

a slight decrease from the 2002 level of 93 wholesalers, excluding sales<br />

employed between 2,500 and 4,999 paid employees, which is the same<br />

range of employees from 2002.<br />
