and a review of processing procedures including hand washing, sanitizing,<br />

equipment sinks, w<strong>at</strong>er potability and food prepar<strong>at</strong>ion. 6<br />

AGRICULTURAL DISTRICTS AND FARMLAND PROTECTION BOARDS<br />

Article 25­AA of the New York St<strong>at</strong>e Agriculture and Markets Law<br />

provides for the cre<strong>at</strong>ion of agricultural districts. In noting the possible loss<br />

of agricultural land for any agricultural purposes, the Constitution of the<br />

St<strong>at</strong>e of New York provides for the protection of agricultural lands. 7 Thus,<br />

Art. 25­AA provides for a locally initi<strong>at</strong>ed mechanism for the protection<br />

and enhancement of New York’s agricultural land, <strong>at</strong> the local level. 8<br />

Each county is permitted to establish a county Agricultural and Farmland<br />

Protection Board, as approved by the local county legisl<strong>at</strong>ive body. The board<br />

is composed of eleven members, four of whom must be active farmers. 9<br />

At least one member must represent agri­business and one member shall<br />

represent an organiz<strong>at</strong>ion dedic<strong>at</strong>ed to agricultural preserv<strong>at</strong>ion. 10 These six<br />

selected members must reside in the county in which the agricultural board<br />

represents. The membership of the board must also include the chairperson<br />

of the county’s soil and w<strong>at</strong>er conserv<strong>at</strong>ion district’s board of directors or an<br />

employee of the county’s soil and conserv<strong>at</strong>ion district (as design<strong>at</strong>ed by the<br />

chairperson), a member of the county legisl<strong>at</strong>ive body, a county cooper<strong>at</strong>ive<br />

extension agent, the county planning director and the county director of<br />

real property tax services. 11 In addition to advising the county legisl<strong>at</strong>ive<br />

body, the board is to work with the county planning board on the proposed<br />

district. 12 The board must also submit expert guidance regarding the n<strong>at</strong>ure<br />

of farming within any proposed or established area, review “notice of intent”<br />

and approve county Agricultural and Farmland Protection plans. 13<br />

The county Agricultural and Farmland Protection Board is also<br />

empowered to submit requests to the Commissioner of Agriculture and<br />
