1 Introducti<strong>on</strong><br />
1.1 Preamble<br />
Problems associated with nuisance odour <strong>and</strong> noise emissi<strong>on</strong>s <strong>from</strong> commercial kitchen<br />
exhausts are very comm<strong>on</strong>, particularly in urban areas where housing may be adjacent<br />
to or even immediately above catering premises. These premises might include pubs,<br />
clubs, restaurants <strong>and</strong> takeaways that may be open until <strong>the</strong> early hours <strong>of</strong> <strong>the</strong> morning.<br />
Resp<strong>on</strong>sibility for <strong>the</strong> enforcement <strong>of</strong> statutory c<strong>on</strong>trols available to Local Authorities is<br />
shared between a number <strong>of</strong> regulatory functi<strong>on</strong>s;<br />
• An authority’s Building C<strong>on</strong>trol Officer would usually h<strong>and</strong>le building Regulati<strong>on</strong><br />
requirements relating to <strong>the</strong> structural safety <strong>of</strong> installati<strong>on</strong>s such as high exhaust<br />
flues;<br />
• Planning issues relating to new premises, <strong>and</strong> to <strong>the</strong> acceptability <strong>and</strong> positi<strong>on</strong>ing<br />
<strong>of</strong> new ventilati<strong>on</strong> systems that involve <strong>the</strong> provisi<strong>on</strong> <strong>of</strong> a large flue, are likely to<br />
require planning c<strong>on</strong>sent, <strong>the</strong> applicati<strong>on</strong> for which would be submitted to <strong>the</strong><br />
Local Planning Authority (or <strong>the</strong> Planning Service in <strong>the</strong> Department <strong>of</strong> <strong>the</strong><br />
Envir<strong>on</strong>ment in Nor<strong>the</strong>rn Irel<strong>and</strong>);<br />
• Envir<strong>on</strong>mental Health Officers providing advice <strong>on</strong> <strong>the</strong> odour <strong>and</strong> noise c<strong>on</strong>trol<br />
aspects <strong>of</strong> any planning applicati<strong>on</strong> to <strong>the</strong> Planning Officers; <strong>and</strong><br />
• Envir<strong>on</strong>mental Health Officers/Technical Officers would deal with any complaints<br />
<strong>of</strong> statutory nuisance arising <strong>from</strong> <strong>the</strong> smell or noise <strong>of</strong> a kitchen extracti<strong>on</strong><br />
system.<br />
Many kitchen extracti<strong>on</strong> systems are well designed, well maintained <strong>and</strong> seldom cause<br />
nuisance problems. O<strong>the</strong>rs can provide a significant <strong>and</strong> recurring source <strong>of</strong> nuisance.<br />
Currently, <strong>the</strong>re is little advice available to <strong>the</strong> enforcing <strong>of</strong>ficers <strong>on</strong> what measures may<br />
c<strong>on</strong>stitute best practicable means for abating <strong>the</strong> nuisance. Apart <strong>from</strong> <strong>the</strong> statutory<br />
nuisance aspects, kitchen exhaust system design may also:<br />
• influence <strong>the</strong> work place envir<strong>on</strong>ment where temperature <strong>and</strong> fume c<strong>on</strong>trol is<br />
important; or<br />
• have fire safety <strong>and</strong> hygiene implicati<strong>on</strong>s where systems are poorly maintained.<br />
Status <strong>of</strong> this guidance<br />
This guidance document, prepared by Netcen an operating divisi<strong>on</strong> <strong>of</strong> AEA Technology,<br />
is sought by <strong>Defra</strong>, <strong>and</strong> through it <strong>the</strong> Devolved Administrati<strong>on</strong>s <strong>of</strong> <strong>the</strong> Scottish<br />
Executive, <strong>the</strong> Nati<strong>on</strong>al Assembly for Wales, <strong>and</strong> <strong>the</strong> Department <strong>of</strong> <strong>the</strong> Envir<strong>on</strong>ment in<br />
Nor<strong>the</strong>rn Irel<strong>and</strong> to provide clear guidance to <strong>the</strong> regulati<strong>on</strong> process. Although this<br />
guidance is not statutory, it provides informati<strong>on</strong> <strong>on</strong> best practice techniques for <strong>the</strong><br />
minimisati<strong>on</strong> <strong>of</strong> odour <strong>and</strong> noise nuisance <strong>from</strong> kitchen exhaust systems.<br />
