3.1.4 Regulati<strong>on</strong> in resp<strong>on</strong>se to a change <strong>of</strong> use not requiring planning<br />
permissi<strong>on</strong><br />
In most cases a change in use <strong>of</strong> a premises will require planning permissi<strong>on</strong>.<br />
However, if both <strong>the</strong> original <strong>and</strong> <strong>the</strong> planned future use fall within <strong>the</strong> same use class<br />
(as defined within <strong>the</strong> Town <strong>and</strong> Country Planning (Use Classes) Order, <strong>the</strong>n<br />
planning permissi<strong>on</strong> is not required. In terms <strong>of</strong> commercial kitchens, this would<br />
include for example a change in use <strong>from</strong> a tea shop to an Indian restaurant. Both <strong>of</strong><br />
which would fall under Use Class A3 that includes “use for <strong>the</strong> sale <strong>of</strong> food or drink<br />
for c<strong>on</strong>sumpti<strong>on</strong> <strong>on</strong> <strong>the</strong> premises or <strong>of</strong> hot food for c<strong>on</strong>sumpti<strong>on</strong> <strong>of</strong>f <strong>the</strong> premises”.<br />
Table 3.3 summarises <strong>the</strong> roles <strong>of</strong> each <strong>of</strong> <strong>the</strong> local authority <strong>of</strong>ficers in such a<br />
situati<strong>on</strong>.<br />
