� Health <strong>and</strong> Safety legislati<strong>on</strong>/guidance<br />

In relati<strong>on</strong> to general ventilati<strong>on</strong> in <strong>the</strong> workplace, <strong>the</strong> Workplace (Health, Safety <strong>and</strong><br />

Welfare) Regulati<strong>on</strong>s 1992 [17] require that ‘an effective <strong>and</strong> suitable provisi<strong>on</strong> shall be<br />

made to ensure that every enclosed workplace is ventilated by a sufficient quantity <strong>of</strong><br />

fresh or purified air’. Directly related to commercial kitchens, <strong>the</strong> Health <strong>and</strong> Safety<br />

Executive (HSE) have produced a reference sheet with <strong>the</strong> title “Ventilati<strong>on</strong> <strong>of</strong><br />

kitchens in catering establishments”. This provides guidance <strong>on</strong> how to assess <strong>the</strong><br />

adequacy <strong>of</strong> any existing ventilati<strong>on</strong> equipment, <strong>and</strong> <strong>the</strong> ventilati<strong>on</strong> requirements for<br />

new build kitchens.<br />

The <strong>Noise</strong> at Work Regulati<strong>on</strong>s 1989 [18] specify Acti<strong>on</strong> Levels that relate to <strong>the</strong> “daily<br />

pers<strong>on</strong>al noise exposure” (LEP,d) <strong>of</strong> workers. At <strong>the</strong> first Acti<strong>on</strong> Level (LEP,d = 85<br />

dB(A)) ear protecti<strong>on</strong> must be provided <strong>and</strong> at <strong>the</strong> sec<strong>on</strong>d Acti<strong>on</strong> Level (LEP,d = 90<br />

dB(A)) ear protecti<strong>on</strong> must be worn. The Acti<strong>on</strong> Levels will reduce in <strong>the</strong> near future<br />

when <strong>the</strong> requirements <strong>of</strong> <strong>the</strong> EC Physical Agents Directive (<strong>Noise</strong>) 2003 come into<br />

force. <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> <strong>on</strong> plant noise for unoccupied spaces is given in BS8233 (1999) [19] .<br />

� Food Hygiene Legislati<strong>on</strong><br />

The relevant secti<strong>on</strong>s <strong>of</strong> <strong>the</strong> Food Safety (General Food Hygiene) Regulati<strong>on</strong>s<br />

1995 [20] require that:<br />

• <strong>the</strong>re must be suitable <strong>and</strong> sufficient means <strong>of</strong> ei<strong>the</strong>r natural or mechanical<br />

ventilati<strong>on</strong>;<br />

• mechanical air flow <strong>from</strong> a c<strong>on</strong>taminated area to a clean area must be avoided;<br />

<strong>and</strong><br />

• ventilati<strong>on</strong> systems must be so c<strong>on</strong>structed as to enable filters <strong>and</strong> o<strong>the</strong>r parts<br />

requiring cleaning or replacement to be readily accessible.<br />

� Fire preventi<strong>on</strong> legislati<strong>on</strong><br />

Proprietors <strong>of</strong> commercial kitchens are under a duty to ensure that <strong>the</strong> fire<br />

precauti<strong>on</strong>s meet <strong>the</strong> requirements <strong>of</strong> <strong>the</strong> “Fire Precauti<strong>on</strong> (Workplace) Regulati<strong>on</strong>s<br />

1997 [3] .<br />

3.2.2 Industry guidance/st<strong>and</strong>ards<br />

The Heating <strong>and</strong> Ventilati<strong>on</strong> C<strong>on</strong>tractors’ Associati<strong>on</strong> (HVCA), who aim to provide<br />

st<strong>and</strong>ards for <strong>the</strong> design <strong>of</strong> commercial kitchen ventilati<strong>on</strong> systems, have produced<br />

relevant industry guidance. Their publicati<strong>on</strong>s, al<strong>on</strong>g with o<strong>the</strong>r available relevant<br />

industry guidance, are listed below:<br />

• HVCA St<strong>and</strong>ard for Kitchen Ventilati<strong>on</strong> Systems, DW 171, 1999 [21] ;<br />

• HVCA St<strong>and</strong>ard for Cleanliness <strong>of</strong> Ventilati<strong>on</strong> Systems, TR 17, 2002 [22] ;<br />

<strong>and</strong><br />

• Building Services Research <strong>and</strong> Informati<strong>on</strong> Associati<strong>on</strong> FMS 1/97 S [23] .<br />
