planning permissi<strong>on</strong> is refused.<br />
Although in <strong>the</strong>ory c<strong>on</strong>diti<strong>on</strong>s<br />
are <strong>from</strong> <strong>the</strong> planning<br />
department, in practice, EHO<br />
has direct c<strong>on</strong>tact with<br />
applicant to establish odour<br />
c<strong>on</strong>trol scheme, <strong>and</strong> advises<br />
planner <strong>on</strong> whe<strong>the</strong>r<br />
appropriate. Any changes to<br />
be made will be discussed<br />
directly with <strong>the</strong> applicant.<br />
The EHO may recommend<br />
refusal <strong>of</strong> planning permissi<strong>on</strong><br />
if in <strong>the</strong>ir opini<strong>on</strong> <strong>the</strong><br />
development will cause<br />
significant loss <strong>of</strong> amenity or<br />
statutory nuisance that cannot<br />
be mitigated with c<strong>on</strong>diti<strong>on</strong>s.<br />
Premises will be visited at a<br />
frequency set according to risk<br />
assessment <strong>of</strong> premises to<br />
check food hygiene<br />
requirements. No m<strong>on</strong>itoring in<br />
terms <strong>of</strong> odour/noise.<br />
1 Building regulati<strong>on</strong>s approval <strong>on</strong>ly has to be sought where building structure is affected – i.e. always<br />
in <strong>the</strong> case <strong>of</strong> a new build commercial kitchen, usually for an extensi<strong>on</strong> to an existing building, but <strong>on</strong>ly<br />
sometimes in relati<strong>on</strong> to change in use.
