Roddy Brett<strong>Racism</strong> <strong>and</strong> the <strong>Guatemala</strong>n State2004-2008: <strong>Racism</strong> <strong>and</strong> the Multicultural State 9The Procuraduría de los Derechos Humanos (PDH) was established <strong>in</strong> the1985 Political Constitution <strong>of</strong> the Republic (articles 273-275), the first <strong>of</strong> itsk<strong>in</strong>d <strong>in</strong> the Lat<strong>in</strong> American region, m<strong>and</strong>ated to receive compla<strong>in</strong>ts regard<strong>in</strong>ghuman rights violations, promote human rights <strong>and</strong> monitor the state <strong>in</strong>terms <strong>of</strong> compliance with its <strong>in</strong>stitutional obligations <strong>in</strong> this regard. The PDHwas created around the central figure <strong>of</strong> the Ombudsman, whose role was topromote the effective adm<strong>in</strong>istrative function <strong>of</strong> government with<strong>in</strong> a humanrights framework (Congressional Decree 54-86 <strong>and</strong> 32-87, article 13). However,given the personalized constitutional m<strong>and</strong>ate, from its <strong>in</strong>ception the <strong>in</strong>stitutionhas rema<strong>in</strong>ed centralized <strong>and</strong> subject to personalist politics. 10Over time the PDH began to develop specific units dedicated to the defense<strong>of</strong> particular populations, sectors or rights, <strong>in</strong>clud<strong>in</strong>g the rights <strong>of</strong> women <strong>and</strong><strong>of</strong> children. In 1993, <strong>in</strong>itial moves were made to establish a unit dedicated tothe rights <strong>of</strong> <strong>in</strong>digenous peoples. However, despite such efforts <strong>and</strong> the stateobligation enshr<strong>in</strong>ed with<strong>in</strong> the 1996 Peace Accord Concern<strong>in</strong>g the Identity<strong>and</strong> Rights <strong>of</strong> Indigenous People (AIDPI) to establish this unit, it was not until1997 that the Defensoría de los Derechos de los Pueblos Indígenas (DDPI) wasf<strong>in</strong>ally created. Certa<strong>in</strong> external factors, such as divisions with<strong>in</strong> the Mayanmovement, had impeded the creation <strong>of</strong> the DDPI. However, <strong>in</strong>terviewees citedracist attitudes evident <strong>in</strong> systematic resistance <strong>and</strong> <strong>in</strong>difference with<strong>in</strong> the PDH<strong>and</strong> the lack <strong>of</strong> assigned <strong>in</strong>stitutional budget for the unit, as the key factors <strong>in</strong>this regard. Significantly, even s<strong>in</strong>ce the <strong>of</strong>fice has been established, it has beensubject to resistance from with<strong>in</strong> the PDH, <strong>in</strong>clud<strong>in</strong>g the systematic absence<strong>of</strong> an adequate budget, 11 racist attitudes <strong>and</strong> <strong>in</strong>difference <strong>of</strong> the <strong>in</strong>stitution’spersonnel, limit<strong>in</strong>g the unit’s capacity to carry out its <strong>in</strong>stitutional m<strong>and</strong>ateeffectively.Accord<strong>in</strong>g to Martín Sacalxot, the present Director <strong>of</strong> the DDPI:Initially, there was serious <strong>in</strong>ternal resistance. It was said that the unitwould divide the PDH. These accusations came from people who didnot see the <strong>in</strong>digenous struggle as someth<strong>in</strong>g positive, but rather as athreat. An order came from the Ombudsman def<strong>in</strong><strong>in</strong>g the Defensoríaas important for the historical struggle <strong>of</strong> Indigenous Peoples. It wasexpla<strong>in</strong>ed that the unit had its foundation <strong>in</strong> the Constitution itself<strong>and</strong> <strong>in</strong> the AIDPI, <strong>and</strong> was justified due to the historical problems <strong>of</strong>ab<strong>and</strong>onment, <strong>in</strong>security <strong>and</strong> marg<strong>in</strong>alization <strong>of</strong> Indigenous Peoples.This could not be hidden from or denied by members <strong>of</strong> staff.
