Ter zake van de bevoegdheid van de curator in deze zaak te ageren op grond van
onrechtmatige daad wordt verwezen naar de arresten Peeters/Gatzen 8 en
Lunderstädt/de Kok. 9
De handelwijze van Heineken is des te meer te kwalificeren als onrechtmatig
aangezien Heineken zelf, bij aanbeveling van haar toenmalige voorzitter van de Raad
van Bestuur, de heer A. Ruys, d.d. 19 februari 2003 (productie 99) zich nog op een
zeer positieve wijze heeft uitgelaten over de heer Van Hoorn. Zo schreef de heer Ruys
op deze datum:
“This is to confirm that Mr. Frank van Hoorn has worked for Heineken N.V. on various
projects during the past 10 years, always with impressive result. (…) Mr. Van Hoorn has been
actively involved both in the creative process of preparation and in the down to earth detailed
execution of a number of our music sponsoring programs.
I was personally impressed with his determination, skills, negotiating power and client
awareness. His help in organizing/producing was very well appreciated with the following
events:
- Heineken Green Room (European dance-tour)
- Heineken red Star in the US
- Heineken Music Horizons in Hong Kong
- Heineken Night of the Proms in the Netherlands, Switzerland and Spain
- Heineken NightLive and
- Heineken Crossover Awards in the Netherlands.
I am pleased to recommend Frank van Hoorn on behalf of Heineken N.V.”
Een dergelijke positieve beoordeling over de jarenlange werkzaamheden van de heer
Van Hoorn (lees: curanda) voor Heineken maken de handelwijze van Heineken slechts
5 weken later uiterst onverwacht voor curanda en onrechtmatig. Ten overvloede
worden twee andere aanbevelingen van Pryor Cashman Sherman & Flynn LLP d.d. 14
februari 2003 (productie 100) en van MTV Networks Europe d.d. 17 februari 2003
(productie 101) in het geding gebracht. Howard Siegel advocaat bij Pryor Cashman
Sherman & Flynn LLP, auteur van diverse artikelen en een boek en adjunct Professor
of Law aan Fordham Law School heeft onder meer het navolgende over Frank van
hoorn verklaard:
