and husband of the said Elizabeth <strong>Sterling</strong>e, the parties to these<br />

p r esents Did by his last Will & Testament, duely probed in the<br />

Court of the said County of Northampton the twenty eighth day<br />

of October last past; Gibe and bequeath to the said Elizabeth,<br />

his then wife, ail the Tract or Debident of Land hee hbed on<br />

Either in fee Simple or by Lease for terme of Years to her and<br />

her disposinge, Containinge Two Hundred and Sixty Acres one<br />

hundred and Sixty Acres thereof Leased of John Smith and the<br />

1' other hundred Acres Residue thereof purchased of M William<br />

Mellinge, Sen 1<br />

., deced, as the same is Scituate, lying and beinge in<br />

the County of Northampton, aforesaid, Withali houses, Editices,<br />

Buildings, orchards, fences and other Appurtenances whatsoeDer<br />

thereunto belonginge or in anywise appertaininge. As also Unto<br />

his said son Ricliard <strong>Sterling</strong>e he Gabe and bequeathed his planta-<br />

tion on Pocomoke Riber in the County of Accomock in Virgini a ,<br />

Containinge three hundred Acres of Land withail houses, Edifices,<br />

Buildings, Orchards, fences and other Appurtenances whatsoeber<br />

thereunto belonginge or in any wise Appertaininge.<br />

As in and by tne last Will & Testament of tne Said William<br />

<strong>Sterling</strong>e Kemaineinge on the Records of the said County (Relacon<br />

beinge thereunto had ) as may more at large and plamely Appeare<br />

And .forasmuch as by the mutual! consent of the Said liichard<br />

<strong>Sterling</strong>, the son and Elizabeth <strong>Sterling</strong>e, the widow of the Said<br />

deced c William <strong>Sterling</strong>e and parties to these p'sents<br />

<strong>The</strong>y Unanimously Agreed and Accordingly proceeded to &<br />

performed the Debision of the said Decedents instate Equally Be-<br />

tweene them, the said Richard and Elizabeth and to pay tne said<br />

Estates debts equally betweene them; And also on the considera-<br />

tion aforesaid m like manner Agreed on Reasonable Notice to<br />

each other by themselves or their Assignes to Relinquish and<br />

Release their Seberal and Respectibe Rights & titles of the abobe-<br />

said Tracts or Debidents of Band soe particularly giben them by<br />

the last Will and Testament of the said William <strong>Sterling</strong>e, deed 1<br />

By Sufficient Deed Bidented Under their hands and seals to be<br />

duely Acknowledged and perfected in open court as by them or<br />

either of them or either of their heirs or Assigns or Councell learned<br />

in the Law shall bee Reasonably Adbised, debised or Acquired.
