In the homelands, communal tenure was <strong>of</strong>ficially defined by<br />

Proclamation R188 <strong>of</strong> 1969 as “unsurveyed land” or “permission” to<br />

occupy” 508 . Under the Proclamation, a male person held rights to various<br />

land allotments for residential use, arable farming and grazing 509 . People<br />

did not legally own their residential and arable allotments. Rather they<br />

were allowed the right <strong>of</strong> occupation and cultivation subject to conditions<br />

stipulated by the homeland authorities. This was also applicable to the<br />

Makgabeng farms.<br />

Other plans which the homeland authorities brought to the rural lands<br />

such as those in Makgabeng, included the so-called “betterment”, which<br />
