8.5 GERMANY<br />

8.5.1 Health care organ<strong>is</strong>ation <strong>in</strong> general<br />

A fundamental aspect of the German health care system <strong>is</strong> the shar<strong>in</strong>g of dec<strong>is</strong>ionmak<strong>in</strong>g<br />

powers between the federal government, the <strong>in</strong>dividual states (Länder), and<br />

designated self-governmental <strong>in</strong>stitutions. Responsibilities are delegated to membership<br />

based, selfregulated <strong>in</strong>stitutions of payers and providers. <strong>The</strong>se <strong>in</strong>stitutions adopt the<br />

status of quasi-public corporations and guarantee the f<strong>in</strong>anc<strong>in</strong>g and delivery of benefits<br />

outl<strong>in</strong>ed <strong>in</strong> the legal framework of the statutory health <strong>in</strong>surance. <strong>The</strong>y are <strong>in</strong>volved <strong>in</strong><br />

f<strong>in</strong>anc<strong>in</strong>g and deliver<strong>in</strong>g health care.<br />

As <strong>is</strong> the case <strong>in</strong> many other countries, the role of private parties <strong>is</strong> penetrat<strong>in</strong>g the<br />

organ<strong>is</strong>ational pr<strong>in</strong>ciples of the health care model.<br />

8.5.1.1 Health <strong>in</strong>surance<br />

In the Statutory Health Insurance (SHI), (cover<strong>in</strong>g 88% of the population), sickness<br />

funds, their associations and associations of SHI-affiliated physicians and dent<strong>is</strong>ts<br />

negotiate on the <strong>in</strong>sured care. <strong>The</strong> most important body <strong>in</strong> the benefit negotiations<br />

between sickness funds and physicians concern<strong>in</strong>g the scope of benefits <strong>is</strong> the Federal<br />

Jo<strong>in</strong>t Committee. Based on the leg<strong>is</strong>lative framework the Committee <strong>is</strong>sues directives<br />

relat<strong>in</strong>g to all sectors of care.<br />

Citizens have a free choice of sickness funds. Employees <strong>with</strong> a gross monthly <strong>in</strong>come<br />

not exceed<strong>in</strong>g a certa<strong>in</strong> amount (€3.862 <strong>in</strong> 2004) are mandatory to have a membership<br />

<strong>in</strong> a sickness fund. Higher <strong>in</strong>come levels can opt out. Private <strong>in</strong>surance companies<br />

provide health <strong>in</strong>surance policies that are substitutive or supplementary to the SHI.<br />

<strong>The</strong> autonomous sickness funds are organized on a regional and/or federal bas<strong>is</strong>. <strong>The</strong>y<br />

are obliged to ra<strong>is</strong>e contributions from their members and to determ<strong>in</strong>e the<br />

contribution rate necessary to cover expenditures. <strong>The</strong>ir responsibilities <strong>in</strong>clude<br />

contract<strong>in</strong>g, negotiat<strong>in</strong>g prices, quantity and quality assurance measures. Services<br />

covered by such contracts are usually accessible to all fund members <strong>with</strong>out any prior<br />

approval by the fund, except for preventive spa treatments, rehabilitative services and<br />

short-term home nurs<strong>in</strong>g care that require an <strong>in</strong>dication sett<strong>in</strong>g.<br />

A r<strong>is</strong>k structure compensation scheme <strong>is</strong> <strong>in</strong> place which prevents the sickness funds to<br />

refuse people at a higher r<strong>is</strong>k for health care services. Members and their dependents<br />

are entitled for the benefits: prevention of d<strong>is</strong>ease, screen<strong>in</strong>g for d<strong>is</strong>ease, emergency and<br />

rescue care and treatment of d<strong>is</strong>ease. In the latter category ambulatory care, care by<br />

allied health professionals and certa<strong>in</strong> areas or rehabilitative care are <strong>in</strong>cluded.<br />

Ambulatory care <strong>is</strong> only described <strong>in</strong> generic terms whereas care by allied health<br />

professionals <strong>is</strong> more elaborated. <strong>The</strong>se services that are reimbursed by the SHI are<br />

l<strong>in</strong>ked to <strong>in</strong>dications and therapeutic targets and need to be prescribed by a physician.<br />

8.5.1.2 Health care policy mak<strong>in</strong>g and organ<strong>is</strong>ation<br />

<strong>The</strong> leg<strong>is</strong>lative authority regulates the procedures <strong>with</strong> which the contractual partners<br />

determ<strong>in</strong>e the scope of SHI services. <strong>The</strong> “Federal Jo<strong>in</strong>t Committee” <strong>is</strong>sues directives<br />

about adequate and cost-effective medical <strong>in</strong>terventions for the <strong>in</strong>sured persons. In the<br />

Länder as well as <strong>in</strong> the federal government, a department of health <strong>is</strong> <strong>in</strong>stalled, although<br />

not always as a d<strong>is</strong>t<strong>in</strong>ct m<strong>in</strong><strong>is</strong>try. <strong>The</strong> sickness funds have a central position <strong>in</strong> the health<br />

<strong>in</strong>surance system.<br />

<strong>The</strong> sickness funds are obliged to collect contributions from their members. In return<br />

these funds negotiate prices, quantities and quality <strong>with</strong> providers on behalf of their<br />

members.<br />

Health care delivery <strong>in</strong> Germany <strong>is</strong> typified by a clear del<strong>in</strong>eation between public health<br />

services, ambulatory care and hospital care. <strong>The</strong> ‘strict’ legal and f<strong>in</strong>ancial del<strong>in</strong>eation
