(2) A deficit is calculated according to the following formula:<br />

Di = RVOi - [(∑RINVOL)i + (∑RINVOL)i-1]<br />
Di = The deficit generated in calendar year i that must be carried over to year i+1 if<br />
allowed pursuant to paragraph (b)(1)(i) <strong>of</strong> this section, in gallons.<br />
RVOi = The <strong>Renewable</strong> Volume Obligation for the obligated party or renewable fuel<br />
exporter for calendar year i, in gallons.<br />
(∑RINVOL)i = Sum <strong>of</strong> all acquired gallon-RINs that were generated in year i <strong>and</strong> are<br />
being applied towards the RVOi, in gallons.<br />
(∑RINVOL)i-1 = Sum <strong>of</strong> all acquired gallon-RINs that were generated in year i-1 <strong>and</strong><br />
are being applied towards the RVOi, in gallons.<br />
§ 80.1128 General requirements for RIN distribution.<br />
(a) RINs assigned to batches <strong>of</strong> renewable fuel.<br />
(1) Except as provided in §80.1129 <strong>and</strong> paragraph (a)(3) <strong>of</strong> this section, as title to a<br />
batch <strong>of</strong> renewable fuel is transferred from one party to another, a batch-RIN that<br />
has been assigned to that batch according to §80.1126(d) must remain assigned to<br />
an equivalent renewable fuel volume having the same equivalence value.<br />
(i) A batch-RIN assigned to a batch shall be identified on product transfer documents<br />
representing the batch pursuant to §80.1153.<br />
(ii) Any documentation used to transfer custody <strong>of</strong> or title to a batch from one party<br />
to another must identify the batch-RINs assigned to that batch.<br />
(2) If two or more batches <strong>of</strong> renewable fuel are combined into a single batch, then all<br />
the batch-RINs assigned to all the batches involved in the merger shall be<br />
assigned to the final combined batch.<br />
(3) If a batch <strong>of</strong> renewable fuel is split into two or more smaller batches, any batch-<br />
RINs assigned to the parent batch must likewise be split <strong>and</strong> assigned to the<br />
daughter batches.<br />
(i) If the Equivalence Value for the renewable fuel in the parent batch is equal to or<br />
greater than 1.0, then there shall be at least one gallon-RIN for every gallon in<br />
each <strong>of</strong> the daughter batches.<br />
(ii) If the Equivalence Value for the renewable fuel in the parent batch is less than<br />
1.0, then the ratio <strong>of</strong> gallon-RINs to gallons in the parent batch shall be preserved<br />
in all daughter batches.<br />
(iii) For purposes <strong>of</strong> this paragraph (a)(3), the volume <strong>of</strong> each parent <strong>and</strong> daughter<br />
batch shall be st<strong>and</strong>ardized to 60 o F pursuant to §80.1126(c)(7).<br />
(b) RINs not assigned to batches <strong>of</strong> renewable fuel.<br />
(1) Unassigned RIN means one <strong>of</strong> the following:<br />
(i) It is a RIN that contains a K value identifying it as an extra-value RIN <strong>and</strong> was<br />
not assigned to a batch <strong>of</strong> renewable fuel by the producer or importer <strong>of</strong> that<br />
batch; or<br />
(ii) It is a RIN that was separated from the batch to which it was assigned in<br />
accordance with §80.1129.<br />
