(a) (1) Any party that exports any amount <strong>of</strong> renewable fuel shall acquire<br />

sufficient RINs to <strong>of</strong>fset a <strong>Renewable</strong> Volume Obligation representing the<br />

exported renewable fuel.<br />

(2) Only exporters located in the applicable region described in §80.1126(a) are<br />

subject to the requirements <strong>of</strong> this section.<br />

(b) <strong>Renewable</strong> Volume Obligations. An exporter <strong>of</strong> renewable fuel shall determine<br />

its <strong>Renewable</strong> Volume Obligation from the volumes <strong>of</strong> the batches exported.<br />

(1) A renewable fuel exporter's total <strong>Renewable</strong> Volume Obligation shall be<br />

calculated according to the following formula:<br />

RVOi = ∑(VOLk * EVk) + Di-1<br />

Where:<br />

k = Batch.<br />

RVOi = The <strong>Renewable</strong> Volume Obligation for the exporter for calendar year i, in gallons<br />

<strong>of</strong> renewable fuel.<br />

VOLk = The st<strong>and</strong>ardized volume <strong>of</strong> batch k <strong>of</strong> exported renewable fuel, in gallons.<br />

EVk = The equivalence value for batch k.<br />

Di-1<br />

= <strong>Renewable</strong> fuel deficit carryover from the previous year, in gallons.<br />

(2) (i) For exported batches <strong>of</strong> renewable fuel that have assigned RINs, the<br />

equivalence value may be determined from the RR component <strong>of</strong> the RIN.<br />

(ii) If a batch <strong>of</strong> renewable fuel does not have assigned RINs but its equivalence value<br />

may nevertheless be determined pursuant to §80.1115(d) based on its<br />

composition, then the appropriate equivalence value shall be used in the<br />

calculation <strong>of</strong> the exporter's <strong>Renewable</strong> Volume Obligation.<br />

(iii) If the equivalence value for a batch <strong>of</strong> renewable fuel cannot be determined, the<br />

value <strong>of</strong> EVk shall be 1.0.<br />

(3) If the exporter <strong>of</strong> a batch <strong>of</strong> renewable fuel is also the producer <strong>of</strong> that batch, <strong>and</strong><br />

no RIN was generated to represent that batch, then the volume <strong>of</strong> that batch shall<br />

be excluded from the calculation <strong>of</strong> the <strong>Renewable</strong> Volume Obligation.<br />

(c) Each exporter <strong>of</strong> renewable fuel must demonstrate compliance with its RVO using<br />

RINs it has acquired pursuant to §80.1127.<br />

§ 80.1131 Treatment <strong>of</strong> invalid RINs.<br />

(a) Invalid RINs. An invalid RIN is a RIN that:<br />

(1) Is a duplicate <strong>of</strong> a valid RIN;<br />

(2) Was based on volumes that have not been st<strong>and</strong>ardized to 60 °F;<br />

(3) Has expired;<br />

(4) Was based on an incorrect equivalence value; or<br />

(5) Was otherwise improperly generated.<br />

(b) In the case <strong>of</strong> RINs that have been determined to be invalid, the following<br />

provisions apply:<br />

(1) Invalid RINs cannot be used to achieve compliance with the transferee’s<br />

<strong>Renewable</strong> Volume Obligation, regardless <strong>of</strong> the transferee’s good faith belief<br />

that the RINs were valid.<br />
