(2) Any party that has registered pursuant to §80.1150 can hold title to an unassigned<br />
RIN.<br />
(3) Unassigned RINs can be transferred from one party to another any number <strong>of</strong><br />
times.<br />
(4) An unassigned batch-RIN can be divided by its holder into two batch-RINs, each<br />
representing a smaller number <strong>of</strong> gallon-RINs if all <strong>of</strong> the following conditions<br />
are met:<br />
(i) All RIN components other than SSSSSS <strong>and</strong> EEEEEE are identical for the parent<br />
<strong>and</strong> daughter RINs.<br />
(ii) The sum <strong>of</strong> the gallon-RINs associated with the two daughter batch-RINs is equal<br />
to the gallon-RINs associated with the parent batch.<br />
§ 80.1129 Requirements for separating RINs from batches.<br />
(a) (1) Separation <strong>of</strong> a RIN from a batch means termination <strong>of</strong> the assignment <strong>of</strong> the RIN<br />
from a batch <strong>of</strong> renewable fuel.<br />
(2) A RIN that has been assigned to a batch <strong>of</strong> renewable fuel according to<br />
§80.1126(d) may be separated from a batch only under one <strong>of</strong> the following<br />
conditions:<br />
(i) A party that is an obligated party according to §80.1106 may separate any RINs<br />
that have been assigned to a batch if they own the batch.<br />
(ii) Except as provided in paragraph (a)(2)(v) <strong>of</strong> this section, any party that owns a<br />
batch <strong>of</strong> renewable fuel shall have the right to separate any RINs that have been<br />
assigned to that batch once the batch is blended with gasoline or diesel to produce<br />
a motor vehicle fuel.<br />
(iii) Any party that exports a batch <strong>of</strong> renewable fuel shall have the right to separate<br />
any RINs that have been assigned to the exported batch.<br />
(iv) Except as provided in paragraph (a)(2)(v) <strong>of</strong> this section, any renewable fuel<br />
producer that owns a batch <strong>of</strong> renewable fuel shall have the right to separate any<br />
RINs that have been assigned to that batch if the renewable fuel is designated as<br />
motor vehicle fuel in its neat form <strong>and</strong> is used as motor vehicle fuel in its neat<br />
form.<br />
(v) RINs assigned to batches <strong>of</strong> biodiesel (mono-alkyl esters) can only be separated<br />
from those batches once the biodiesel is blended into diesel fuel at a concentration<br />
<strong>of</strong> 80 volume percent biodiesel or less.<br />
(b) Upon separation from its associated batch, a RIN shall be removed from all<br />
documentation that:<br />
(1) Is used to identify custody or title to the batch; or<br />
(2) Is transferred with the batch.<br />
(c) RINs that have been separated from batches <strong>of</strong> renewable fuel become unassigned<br />
RINs subject to the provisions <strong>of</strong> §80.1128(b).<br />
