Section 10 Permit (Rivers and Harbors)<br />
LEGAL AUTHORITY:<br />
Rivers and Harbors Act - § 10<br />
CONDITIONS REQUIRING PERMITS, AUTHORIZATIONS OR FILINGS:<br />
The purpose of Section 10 is to prevent obstruction or alteration of the nation’s navigable<br />
waters. Any person, agency, or entity, either public or private, proposing construction activity<br />
in or near or altering any navigable water of the United States must obtain a Section 10<br />
permit. In Arizona, Section 10 applies only to the Colorado River and its impoundments (i.e.<br />
Lake Havasu, Lake Mead and Lake Powell).<br />

None<br />
FEES:<br />
There is no application filing fee. A fee is charged upon issuance of an individual permit<br />
($10 for non-commercial projects, $100 for commercial/industrial projects). No fee is charged<br />
for general permit authorizations or Letters of Permission.<br />
AVERAGE PROCESSING TIME:<br />
The individual permit review process typically takes 180 days. Longer processing times may<br />
be expected in more complex projects, or instances where there are endangered species or<br />
cultural resource concerns.<br />
