PERMITS AND AUTHORIZATION:<br />

Notice of Start-up, Move, or Stop for Portable Mining Equipment and Mine<br />

Operations<br />

LEGAL AUTHORITY:<br />

A.R.S. § 27<br />

A.A.C. Title 18 and 27<br />

CONDITIONS REQUIRING PERMITS, AUTHORIZATIONS OR FILINGS:<br />

1) The State Mine Inspector must be notified prior to starting, moving or stopping a mining<br />

operation (A.R.S. § 27-303).<br />

2) Diesel equipment used underground must be permitted annually by the State Mine<br />

Inspector (A.R.S. § 27-365).<br />

3) Elevators at mine property must be inspected and permitted annually by the State Mine<br />

Inspector (A.R.S. § 27-365 and Rule 11-1-1190, Arizona Mining Code).<br />

4) New electrical equipment shall be installed, maintained and used in accordance with the<br />

National Electrical Code.<br />

5) Above ground fuel storage. The State Mine Inspector enforces applicable provisions of the<br />

Uniform Fire Code. Standards of the National Fire Protection Association or other<br />

recognized agencies approved by the Inspector at mine sites.<br />

6) Mined Land Reclamation Plan. Please see Section 2, Land Use.<br />

EXEMPTIONS:<br />

Variances may be applied for, alternate methods must have equal to or better protection<br />

provided for any exposed personnel.<br />

None<br />

AVERAGE PROCESSING TIME:<br />

The Mine Inspector will notify the mine operator by mail, email or fax that the notice has<br />

been received and provide the operator with an ASMI ID number. Diesel permits are issued<br />

within 30 to 45 days.<br />

Elevator permits are issued upon the correction of any deficiencies found. If no deficiencies<br />

are found, permits are issued on completion of the inspection.<br />

Fuel storage does not require a permit, only inspections are necessary.<br />
