CONDITIONS REQUIRING PERMITS, AUTHORIZATIONS OR FILINGS:<br />
Before authorizing activities that have the potential to substantially alter significant<br />
prehistoric or historic properties (cultural resources) on State Trust Land, the Arizona State<br />
Land Department is obligated to consult with the State Historic Preservation Officer to ensure<br />
that significant resources are either avoided or adequately studied before they are impacted.<br />
Proposed ASLD actions that are subject to SHPO review include:<br />
1. Sales of mineral material products.<br />
2. ASLD’s approval of Plans of Operation required under mineral exploration permits,<br />
mineral leases and oil and gas leases.<br />
3. Issuance of haul road rights-of-way.<br />
4. Issuance of Special Land Use Permits authorizing entry onto surface Trust lands for the<br />
purpose of exploring for subsurface federal minerals.<br />
If after consulting with the Arizona State Museum, the ASLD determines that a cultural<br />
resources field survey is needed before the ASLD authorizes the proposed activity, the ASLD<br />
will require the applicant, permittee or lessee to hire a consultant to provide the study for the<br />
ASLD’s use in consulting with the SHPO. Consultants performing cultural resource<br />
investigations on State Trust Land and must obtain an Arizona Antiquities Act Permit from<br />
ASM before beginning field work.
