Solid Waste Notification<br />
LEGAL AUTHORITY:<br />
A.R.S. § 49-762.07<br />
A.R.S. § 49-701.29<br />
CONDITIONS REQUIRING PERMITS, AUTHORIZATIONS OR FILINGS:<br />
Notification is required for any facility that meets the definition of solid waste facility (§ 49-<br />
701.29). A solid waste facility is a transfer facility and any site owned, operated or utilized for<br />
the storage, processing, treatment or disposal of solid waste.<br />
A notification is provided to ADEQ, wherein owners/operators provide the following<br />
information:<br />
1) Facility name and mailing address.<br />
2) Legal description by township, range and section, and county assessor’s book, map and<br />
parcel number.<br />
3) Description of waste storage and treatment equipment, and methods of waste management,<br />
including types and volumes of waste handled, and time the waste remains on site.<br />
4) Description of waste management practices used at the facility, including measures taken<br />
to protect public health and the environment.<br />
5) A diagram of the property, showing the location of the solid waste facility.<br />
EXEMPTIONS:<br />
There are several exemptions to the definition of solid waste facility. See A.R.S. § 49-701.29(a)<br />
through (s) for a complete list. These exemptions include:<br />
1) A site at which solid waste that was generated on site is stored for 90 days or less.<br />
2) A site at which non-putrescible solid waste that was generated on site in amounts of less<br />
than 1,000 kilograms per month per type of non-putrescible solid waste is stored and<br />
contained for 180 days or less.<br />
3) A site that stores, receives, source separates, processes or reduces recyclable solid waste,<br />
and that has no significant adverse effect on the environment.<br />
