Arizona Mining Permitting Guide<br />

PERMITS, AUTHORIZATIONS OR FILINGS:<br />

Permits may be required within city limits.<br />

CONDITIONS FOR ABOVE-GROUND (outside) FUEL STORAGE:<br />

The following is a summary of key design elements compiled from the various<br />

regulations for the storage of combustible liquids in outside storage facilities. Fuel<br />

storage of more 60 gallons, left in place for more than seven consecutive days is<br />

considered a permanent storage facility and is subject to the following standards. All<br />

design elements are based on the stricter of the Uniform Fire Code, NFPA or 29 C.F.R.<br />

1910 or 30 C.F.R. 56.44.<br />

A Spill Prevention Control and Countermeasures (SPCC) plan must be prepared for any<br />

facility with a combined aboveground oil or fuel storage capacity greater than 1320 gallons or<br />

with one or more oil storage containers greater than 660 gallons. Requirements for an SPCC<br />

are found at 40 C.F.R. 112.3(a) - 112.3(d).<br />

Flammable liquids shall be stored in accordance with the standards of the National Fire<br />

Protection Association or other recognized agencies approved by the Arizona State Mine<br />

Inspector (ASMI). (R11-1-306)<br />

All tanks, whether shop built or field erected, shall be strength tested before they are placed in<br />

service. (29 C.F.R. 1910.106 (7))<br />

Flammable Liquid storage when not buried shall not be stored within 100 feet of mine<br />

openings, buildings connected to mine openings, fan installations or housings or hoist houses.<br />

Tanks shall be designed and built in accordance with recognized good engineering standards<br />

for the material of construction, and compatible with the liquid to be stored. (29 C.F.R.<br />
