LEGAL AUTHORITY:<br />
A.R.S. § 49-1004<br />
CONDITIONS REQUIRING PERMITS, AUTHORIZATIONS OR FILINGS:<br />
The owner and operator of an UST are required to notify the department of each release or<br />
suspected release from a UST as soon as practicable but no later than twenty-four (24) hours<br />
after the release or suspected release has been discovered. The Notice may be made orally or<br />
in writing but shall be followed within fourteen (14) days by a written report to the<br />
department that a release or suspected release has been discovered and reported to ADEQ. A<br />
guidance document outlining general UST reporting requirements is available from ADEQ.<br />
EXEMPTIONS:<br />
See A.R.S. §§ 49-1001.17 and 1002.B. and C., and 40 C.F.R. §280.10. For specific<br />
information on deferred or exempt tanks, contact ADEQ at the number above.<br />

AVERAGE PROCESSING TIME:<br />
ADEQ sends out a 14-day and Site Characterization Report request letter within three<br />
calendar days of receiving the notification of a release or a suspected release. This letter<br />
includes information that informs the UST owner and/or operator of what information is<br />
needed in the written report that is due to the department 14 days after the release or suspected<br />
release is discovered and reported to ADEQ. The request letter also provides a release<br />
confirmation and 14-day report form that can be used to provide the information required<br />
within the 14-day time frame.<br />
