Hazardous Waste, Treatment, Storage and Disposal Permit<br />
LEGAL AUTHORITY:<br />
A.R.S. § 49-921<br />
A.A.C. R18-8-260 through 273; 40 C.F.R. 260 through 273<br />
CONDITION REQUIRING PERMITS:<br />
A hazardous waste permit is required for any facility that accepts hazardous waste from<br />
offsite for the purpose of treatment, storage or disposal. A hazardous waste permit is also<br />
required for facilities that generate and store their hazardous waste for longer than specified<br />
time periods. Determining the need for a hazardous waste treatment, storage, and disposal<br />
permit is complex due to numerous requirements and exemptions in EPA rules. Please contact<br />
ADEQ’s Hazardous Waste Permits Unit to discuss your specific needs prior to preparing a<br />
permit application.<br />
A permit application consists of two parts:<br />
(a) Notification of Regulated Waste Activity (EPA Form 8700-12) and a RCRA<br />
Hazardous Waste Part A Permit Application (EPA Form 8700-23).<br />
(b) A description of the applicant's waste, waste management units, management<br />
procedures, waste analysis plan, procedures to respond to emergencies, and a plan to<br />
clean up the facility at the time of closure.<br />

EXEMPTIONS:<br />
There are numerous exemptions from hazardous waste permitting requirements based on<br />
treatment methods, recycling and reclamation methods, and waste quantities. For more details<br />
on exemptions, please contact ADEQ.<br />
FEES:<br />
Fees are based on the time required to process the permit as well as the cost of public notices<br />
and hearing. The initial fee for a hazardous waste permit is $10,000; fees may<br />
