LEGAL AUTHORITY:<br />
Organized Crime Control Act of 1970, Title XI, 18 U.S.C. §§ 1102 et seq.<br />
CONDITIONS REQUIRING PERMITS, AUTHORIZATIONS OR FILINGS:<br />
Manufacturers’ License: Any person, partnership, corporation or association, which engages<br />
in the business of manufacturing explosives materials for purposes of sale or distribution or<br />
for his own use, must first obtain a manufacturer’s license from the ATF. Combining nonexplosive<br />
components to produce an explosive material (such as the mixing of ammonium<br />
nitrate and fuel oil) is also considered manufacturing.<br />
A licensed manufacturer may also receive and transport explosive materials in interstate or<br />
foreign commerce and deal in explosive materials.<br />
User Permit: Any person, partnership, corporation or association, having been issued a user’s<br />
permit, may acquire and use explosives in-state as well as acquire for their own use, explosive<br />
materials from a state other than the state in which they reside or from a foreign country; and<br />
transport explosive materials in interstate or foreign commerce.<br />

FEES:<br />
Original and renewal licenses and permits are valid for a period of three years. Fees and<br />
validity periods were effective December 22, 1998.<br />
Original Manufacture’s License: $200; Renewal: $100.<br />
Original User’s Permit: $100; Renewal: $50.<br />
AVERAGE PROCESSING TIME:<br />
Properly completed applications are acted upon within 45 days of receipt.<br />
