Pollution Prevention Plan<br />

LEGAL AUTHORITY:<br />

A.R.S. § 49-961 through §49-973<br />

CONDITIONS REQUIRING A PERMIT:<br />

A Pollution Prevention Plan must be filed by December 31, of the following year by facilities<br />

or State agencies that:<br />

(a) Were required to file an annual toxic chemical release inventory report Form R pursuant<br />

to Section 313 of the Superfund Amendments and Reauthorization Act of 1986, also<br />

known as Emergency Planning and Community Right to Know Act, Section 3113; or<br />

(b) Shipped off-site, for purposes other than recycling, an average of one kilogram or more<br />

per month (cumulative total) of acutely hazardous wastes; or<br />

(c) Shipped off-site, for purposes other than recycling, more than 12,000 kilograms<br />

(cumulative total) of hazardous wastes in calendar year 1993 or 10,000 kilograms<br />

cumulative total of hazardous waste in calendar year 1994; or<br />

(d) Used more than 10,000 pounds of a toxic substance in a calendar year after December 31,<br />

1994.<br />

A format guidance document, training, and technical assistance are offered by ADEQ.<br />

EXEMPTIONS:<br />

Household hazardous waste collection facilities; agricultural permit holders; permitted<br />

treatment, storage and disposal facilities that primarily receive wastes from off-site;<br />

agricultural pesticide applications subject to A.R.S. §49-305 or §-3-363. For the purpose of<br />

Pollution Prevention Plan filing requirements, "Toxic substance" does not include<br />

material used or produced in connection with a mining or metallurgical operation.<br />

FEES:<br />

There is no fee for pollution prevention certification. In fact, facilities with certified pollution<br />

prevention plans will receive a 50 percent reduction of the required hazardous waste fee<br />

(A.R.S. § 49-931.A.4). Facilities not required to prepare a pollution prevention plan may<br />

voluntarily comply and receive the hazardous waste fee discount.<br />
