for that position. The district must receive a written request for reinstatement, and proof of honorable<br />

discharge or release from military service, within 90 days from the date of that discharge or release.<br />

When short periods of military training or duty cannot be scheduled to coincide with vacation time<br />

or during the summer periods, the employee shall be entitled to a paid leave of absence from his or<br />

her respective duties without loss of time, efficiency rating, vacation time, personal time, sick leave,<br />

or salary on all days during which they shall be engaged in authorized training or duty ordered or<br />

authorized by proper authority, not to exceed fifteen (15) workdays in any one federal fiscal year.<br />

O. FAMILY AND MEDICAL LEAVE OF ABSENCE<br />

1. General Provisions<br />

An employee who has been employed for at least 12 months and has worked at least 1,250<br />

hours during the previous twelve-month period may take an unpaid family or medical leave<br />

of absence for a total of twelve work weeks during any twelve-month period. Separate<br />

periods of employment are counted unless there is a break that exceeds seven years.<br />

A family leave of absence may be taken for the following reasons;<br />

a) because of the birth of a son or daughter of the employee and in order to care for<br />

such son or daughter; or,<br />

b) because of the placement of a son or daughter with the employee for adoption or<br />

foster care.<br />

A family leave expires at the end of the twelve month period after the birth or placement.<br />

A medical leave of absence may be taken for the following reasons:<br />

a) in order to care for the employee's spouse, son, daughter, or parent if such spouse,<br />

son daughter, or parent has a serious health condition; or,<br />

b) because of a serious health condition that makes the employee unable to perform<br />

the functions of the position of such employee.<br />

"Parent" means the employee's biological parent or the person who stood in loco parentis to<br />

the employee when the employee was a son or daughter. "Son or daughter" means the<br />

biological, adopted, or foster child, a stepchild, a legal ward, or a child of a person standing<br />

in loco parentis, who is under 18 years of age or is incapable of self-care because of a<br />

mental or physical disability.<br />

A serious health condition is an illness, injury, impairment or mental condition that involves<br />

either an overnight stay in a medical care facility, or continuing treatment by a health care<br />

provider for a condition that either prevents the employee from performing the functions of<br />

the employee’s job, or prevents the qualified family member from participating in school or<br />

other daily activities. Subject to certain conditions, the continuing treatment requirement<br />

may be met by a period of incapacity of more than three consecutive calendar days<br />

combined with at least two visits to a health care provider or one visit and a regimen of<br />

continuing treatment, or incapacity due to pregnancy, or incapacity due to a chronic<br />

condition. Other conditions may meet the definition of continuing treatment.<br />

A military exigency leave may be taken because of a qualifying exigency, as defined by<br />

federal regulations, arising out of the fact that the spouse, or a son, daughter, or parent of<br />

the employee is on active duty (or has been notified of an impending call or order to active<br />

duty) in the Armed forces in support of a contingency operation.<br />

A service member family leave may be taken by an eligible employee. An eligible<br />

employee is entitled to a total of 26 workweeks of leave during a 12-month period to care<br />

for a covered service member who is the employee’s spouse, son, daughter, parent, or next<br />
