document the recommendations. Upon
receiving a recommendation for aftercare
from the SAP, the employer is encouraged
to create a return-to-duty contract with the
employee that requires the employee to
comply with the aftercare recommendations.
Such a contract spells out desired employee
performance goals and obligations (e.g.,
remaining free of prohibited substances,
complying with aftercare recommendations)
and clearly states the consequences if the
employee fails to adhere to the provisions of
the contract. If a return-to-duty agreement
is created, the employee is obligated to
comply with the SAP’s recommendation for
these services [40.303(c)].

chapter, illustrate the follow-up testing
processes for alcohol and drugs.
