Designated Employer An employee authorized by the employer to take<br />

Representative (DER) immediate action(s) to remove employees from safety<br />

sensitive duties, or cause employees to be removed from<br />

these covered duties, and to make required decisions in<br />

the testing and evaluation processes. The DER also<br />

receives test results and other communications for the<br />

employer, consistent with the requirements of 49 CFR<br />

Part 40. Service agents cannot act as DERs.<br />

Dilute specimen A specimen with creatinine and specific gravity values<br />

that are lower than expected for human urine.<br />

A dilute test will be reported as positive or negative.<br />

For a positive dilute test the employer treats the result as<br />

a positive test and removes the employee from safetysensitive<br />

duty. For a negative dilute test, the employer<br />

may require, as a matter of policy, employees to retest<br />

without direct observation. The second test is the test of<br />

record, even if the second test is also negative dilute.<br />

Disabling damage Damage that precludes departure of a motor vehicle<br />

from the scene of the accident in its usual manner in<br />

daylight after simple repairs. Including, damage to a<br />

motor vehicle, where the vehicle could have been<br />

driven, but would have been damaged further.<br />

Excluding, damage that can be remedied temporarily at<br />

the scene of the accident without special tools or parts.<br />

Tire disablement without other damage even if no spare<br />

tire is available. Headlamp or tail light damage.<br />

Damage to turn signals, horn, or windshield wipers,<br />

which makes the vehicle inoperable.<br />
