Are employees who are subject to testing provided with instructions<br />

explaining their responsibilities in specimen collection?<br />

Split Sample<br />

Is the split specimen procedure being utilized at the collection site?<br />

After the specimen has been collected, it must be divided into two<br />

specimen bottles (30 ml of urine in one primary specimen bottle and 15<br />

ml in the split specimen bottle) in the presence of the donor. If the<br />

primary test returns a positive test result, the employee can request that<br />

the split sample be tested at a separate DHHS laboratory.<br />

Are procedures in place to have a split sample transferred to a second<br />

DHHS lab for analysis? Have you established a business relationship<br />

with the second DHHS lab to ensure that split specimens will be<br />

processed in a timely manner and that the employer will provide<br />

payment for the split analysis (subject to reimbursement by the<br />

employee)?<br />

Insufficient Volume of Specimen<br />

Is the collection site following the correct procedures if the employee<br />

being tested is unable to produce a sufficient amount of urine for the<br />

test?<br />

⎯ Discard the original specimen.<br />

⎯ Obtain another urine sample within 3 hours of the previous test.<br />

The employee cannot drink more than 40 ounces of fluid during<br />

the 3 hours.<br />

Does the employer direct the employee to have a medical examination<br />

within 5 days if 45 ml cannot be provided within 3 hours?<br />

Does the medical physician provide the MRO with a statement<br />

indicating whether or not the insufficient specimen was the result of a<br />

genuine medical condition?<br />

Does the MRO notify the employer in writing of the medical<br />

examination conclusion?<br />

If there is no medical explanation for the insufficient specimen, is the test<br />

regarded as a refusal to be tested?<br />

For a pre-employment test that results in insufficient volume, is a<br />

contingent offer of employment made prior to the medical evaluation?<br />
