SUBSTANCE ABUSE PROFESSIONAL<br />

♦ The FTA regulations require that any individual who refuses a test or has<br />

a verified positive drug test result or a BAC of 0.04 or greater must be<br />

referred to a substance abuse professional (SAP). The SAP determines<br />

what assistance, if any, the employee needs in resolving problems<br />

associated with prohibited drug use or alcohol misuse.<br />

Are all individuals that have refused a test or have a verified positive<br />

drug test result or a breath alcohol test result of 0.04 BAC or greater<br />

referred to an SAP for assessment? Even if the system’s policy<br />

stipulates termination of an employee who receives a verified positive<br />

drug or alcohol test, the system must make such a referral.<br />

Are all applicants who test positive or refuse a pre-employment test<br />

provided with a list of SAPs?<br />

Is the transit system’s SAP a: 1) licensed physician (Doctor of Medicine<br />

or Doctor of Osteopathy), licensed or certified psychologist, social<br />

worker, employee assistance professional; or 2) an addiction counselor<br />

certified by the National Association of Alcoholism and Drug Abuse<br />

Counselors Certification Commission or by the International<br />

Certification Reciprocity Consortium/Alcohol and other Drug Abuse?<br />

Does the SAP have knowledge of and clinical experience in the<br />

diagnosis and treatment of drug and alcohol-related disorders?<br />

Is the SAP knowledgeable about the SAP functions as they relate to<br />

employer interests in safety-sensitive duties?<br />

Does the SAP have basic knowledge about 49 CFR Part 40, DOT/FTA<br />

regulations, and DOT SAP guidelines? Do they keep current on<br />

regulatory changes?<br />

Does the SAP have a copy of the DOT Substance Abuse Professional<br />

<strong>Guidelines</strong>?<br />

Has the SAP met the qualification training and examination<br />

requirements?<br />

Does the SAP receive 12 hours of continuing education every 3 years?<br />

Is the SAP able to conduct a face-to-face clinical assessment?<br />
