These guidelines will assist transit agencies in developing drug and alcohol testing programs that comply with regulations of the <strong>Federal</strong> <strong>Transit</strong><br />

<strong>Administration</strong> (FTA). These regulations were first published in the <strong>Federal</strong> Register on February 15, 1994, as Prevention of Prohibited Drug<br />

Use in <strong>Transit</strong> Operations (49 CFR Part 653) and Prevention of Alcohol Misuse in <strong>Transit</strong> Operations (49 CFR Part 654), and later revised and<br />

combined into one regulation (49 CFR Part 655) on August 1, 2001. These guidelines are directed to transit agencies receiving federal funding<br />

under sections 5307, 5309, and 5311 of the <strong>Federal</strong> <strong>Transit</strong> Act, and section 103(e)(4) of title 23 of the U.S. Code. In addition, these guidelines<br />

will assist state agencies that receive FTA funding and contractors who perform safety-sensitive services for transit agencies.<br />

These guidelines provide a comprehensive, up-to-date summary of the regulatory requirements, incorporating into one publication all of the<br />

guidance the FTA has issued over the past several years including technical assistance, letters of interpretation, audit findings, newsletters,<br />

training classes, and public speaking engagements. The pertinent regulations are cross-referenced throughout the text and are reprinted in their<br />

entirety in Appendix I. Forms, checklists, and lists of additional information and services are provided throughout the document. The<br />

companion volume to this guide (Best Practices manual) discusses “best practices” used by employers to establish and maintain compliant<br />

testing programs.<br />
