1 Refer to <strong>Council</strong>’s Contaminated Land Policy 2004 for a list of<br />
activities that may cause a site to be considered ‘potentially<br />
contaminated land’, and for requirements for development<br />
applications, rezoning and remediation works on contaminated land.<br />
2 Prior to submission of a development application for a site where<br />
contamination may be present, a suitably qualified and experienced<br />
environmental engineer is to assess whether the subject land is<br />
contaminated, on behalf of the applicant.<br />
3 Development applications on contaminated land are to provide<br />
a report on type, location of contamination and measures to<br />
remove and dispose of contaminated materials. The report from<br />
the environmental engineer is to include a statement on whether<br />
the measures proposed will result in the site being suitable for the<br />
proposed development.<br />
Note: State Environmental Planning Policy 55 - Remediation of Land<br />
outlines provisions in relation to contamination and remediation to be<br />
considered in determining a development application.<br />
