of this contract and shall indemnify Company from and against all<br />

claims, demands and causes of action of every kind and character<br />

arising from said pollution or contamination, including but not<br />

limited to that which may result from fire, blowout, cratering seepage<br />

or any other uncontrolled flow of oil, gas, water or other substance,<br />

as well as the use or disposal of oil base mud.<br />

c) In the event a third party commits an act of omission which results<br />

in pollution or contamination for which either the Contractor or<br />

Company, by whom such party is performing work is held to be<br />

legally liable, the responsibility shall be considered as between<br />

Contractor and Company, regardless of the party for whom the job<br />

was performed and liability as set forth in (a) and (b) above would be<br />

specifically applied.<br />

d) In the event effluent / waste pit provided by the Company, getting<br />

filled up in the normal course which can be prevented by Contractor,<br />

the same shall be emptied completely or partially by the Contractor<br />

using disposal pumps, to avoid overflow in the neighboring areas or<br />

alternatively the Company will provide additional pits at its cost. In<br />

case pits so constructed have seepage from the walls of the pit or<br />

bund of the pit, Company will take remedial action to prevent the<br />

same at its cost. However, Company will provide effluent disposal<br />

pipe line to alternate pit away from well site. Contractor shall connect<br />

their pump to Company‟s effluent disposal pipe line at well site.<br />

e) Contractor shall be responsible for any sound/noise pollution arising<br />

out of the Rig package or other items used by Contractor at well site.<br />

Contractor shall sort out the noise/sound pollution with the third<br />

party either by minimizing the sound/noise pollution with<br />

technological means or by compensating the affected people<br />

practicing the system and procedure followed by OIL. Contractor<br />

must ensure that there is no disruption of operation due to<br />

sound/noise pollutions.<br />

11.0 CUSTOMS DUTY<br />

11.1 Company shall use the Drilling units with the Services under the Contract<br />

in the PEL/ML areas renewed / issued to Company after 1.4.1999 and<br />

therefore, in terms of Notification No. 21 dated 01.03.2002, goods specified<br />

in List-12 imported in connection with petroleum operations under this<br />

Contract would attract zero customs duty. Company will issue<br />

Recommendatory Letter to Directorate General of Hydrocarbons(DGH),<br />

Ministry of Petroleum & Natural Gas, as per Government guidelines for<br />

issuance of Essentiality Certificate (EC) from Directorate General of<br />

Hydrocarbons, to enable the Contractor to import goods at concessional (Nil)<br />

customs duty so as to provide the services under this Contract provided<br />

these goods are specified in the List-12 of the aforesaid Notification.<br />

11.2 Bidder should provide the list of items to be imported by them under the<br />

Contract in the format specified in Proforma-A along with their bid for<br />

issuance of Recommendatory Letter to DGH. Contractor shall made written<br />

request to Company immediately after shipment of the goods indicated by
