These guidel<strong>in</strong>es are to be utilized by all counties who receive Federal Medicaid Adm<strong>in</strong>istrative<br />
Salary Shar<strong>in</strong>g (Salary Shar<strong>in</strong>g) revenue from <strong>Office</strong> <strong>of</strong> <strong>Mental</strong> <strong>Health</strong> (OMH). Through<br />
participation <strong>in</strong> the Salary Shar<strong>in</strong>g program, counties can be reimbursed for part <strong>of</strong> the local<br />
governmental cost <strong>of</strong> (a) county staff time associated with the adm<strong>in</strong>istration <strong>of</strong> the mental<br />
health portion <strong>of</strong> the Medicaid program and/or (b) subcontractors who adm<strong>in</strong>ister the mental<br />
health portion <strong>of</strong> the Medicaid program. The local governmental costs associated with the<br />
adm<strong>in</strong>istration <strong>of</strong> the mental health portion <strong>of</strong> the Medicaid program are hereafter referred to as<br />
Local Medicaid Adm<strong>in</strong>istration.<br />
Note: Counties are liable for all Salary Shar<strong>in</strong>g claims subject to Federal and state audit, and<br />
are solely responsible for ensur<strong>in</strong>g that their Salary Shar<strong>in</strong>g claims for Local Medicaid<br />
Adm<strong>in</strong>istration are <strong>in</strong> compliance with applicable Federal Regulations. Regard<strong>in</strong>g Salary Shar<strong>in</strong>g<br />
<strong>in</strong> general, please refer to Title 42 (Public <strong>Health</strong>) <strong>of</strong> the Code <strong>of</strong> Federal Regulations<br />
Consolidated Fiscal Report(<strong>CFR</strong>), Part 433 (<strong>State</strong> Fiscal Adm<strong>in</strong>istration); regard<strong>in</strong>g<br />
subcontracts specifically, please refer to Title 42, <strong>CFR</strong> Part 434.6 (General Requirements For<br />
All Contracts and Subcontracts). All documentation <strong>of</strong> contract specifications must be kept by<br />
the County.<br />
Purposes Toward Which Local Medicaid Adm<strong>in</strong>istration Salary Shar<strong>in</strong>g Revenue Can Be<br />
Applied<br />
Local Medicaid Adm<strong>in</strong>istration Salary Shar<strong>in</strong>g revenue is to be used for county/NYCDMH<br />
operated mental health services only, and must be applied toward either:<br />
• mental health LGU Adm<strong>in</strong>istration costs (OMH program 0890 – LGU Adm<strong>in</strong>istration); or<br />
• any other exclusively-OMH-funded, county/NYCDMH operated mental health program<br />
costs (i.e., programs that receive fund<strong>in</strong>g through OMH fund<strong>in</strong>g sources such as Local<br />
Assistance and Community Support Services (CSS), and this <strong>in</strong>cludes non-Medicaidable<br />
programs).<br />
Procedure To Be Followed If Local Medicaid Adm<strong>in</strong>istration Salary Shar<strong>in</strong>g Revenue Is To Be<br />
Utilized For Lgu Program Expansion<br />
If, dur<strong>in</strong>g the course <strong>of</strong> the year, the Local Medicaid Adm<strong>in</strong>istration Salary Shar<strong>in</strong>g revenue<br />
received from OMH is used specifically for OMH LGU adm<strong>in</strong>istration program expansion (OMH<br />
program 0890), then the expenditures related to LGU program expansion must be assigned<br />
entirely to OMH, and therefore, the total amount <strong>of</strong> LGU adm<strong>in</strong>istration expenses split among<br />
the participat<strong>in</strong>g disabilities is to be reduced by an amount equal to the expenditures related to<br />
OMH LGU Adm<strong>in</strong>istration program expansion. After the LGU Adm<strong>in</strong>istration expenses have<br />
been reduced, calculate the shares assigned to each disability based on the “Department <strong>of</strong><br />
<strong>Mental</strong> <strong>Health</strong> County Adm<strong>in</strong>istration Percentage Splits for the Year 1988". The LGU
