TERMINATION OF EMPLOYMENT LICENCIEMENT<br />
"notice of termination" means a written notice of<br />
termination of employment given by an employer to an<br />
employee in accordance with subsection 14.03(2);<br />

"temporary layoff" means an interruption of the<br />
employment of an employee by an employer for a<br />
period<br />
(a) not exceeding 45 days of layoff in a<br />
period of 60 consecutive days, or<br />
(b) exceeding 45 days of layoff, where the<br />
employer recalls the employee to<br />
employment within a time fixed by the<br />

"termination pay" means a payment made by an<br />
employer to an employee in accordance with<br />

14.02. For the purpose of this Part, where an employee<br />
has been employed by the same employer more than<br />
once, those periods of employment shall be deemed to<br />
be one period of employment if not more than 90 days<br />
have elapsed between each period of employment.<br />

14.03. (1) No employer shall terminate the employment<br />
of an employee who has been employed by that<br />
employer for a period of 90 days or more, unless the<br />
employer<br />
(a) gives the employee notice of termination;<br />
or<br />
(b) pays the employee termination pay.<br />
(2) An employer who wishes to terminate the<br />
employment of an employee by notice of termination<br />

14.03. (1) L’employeur ne peut licencier l’employé qui<br />
a été à son service pendant une période égale ou<br />
supérieure à 90 jours qu’à l’une ou l’autre des<br />
conditions suivantes :<br />
a) il lui donne un préavis de licenciement;<br />
b) il lui verse une indemnité de<br />
licenciement.<br />
(2) L’employeur qui désire licencier un employé<br />
