xciv MINING LAWS OF PENNSYLVANIA. Off. Doo.Section 13. Whenever a petition signed by fifteen or more reputablecoal operators or miners, or both, setting forth that any insijectorof mines neglects his duties, or is incompetent, or is guilty ofmalfeasance in office, it shall be the duty of the court of commonpleas of the proper county to issue a citation in the name of theCommonwealth to the said inspector to appear at not less than uvedays' notice, on a day fixed, before said court aud the court shallthen proceed to inquire into and investigate the allegations ot thepetitioners. If the court find that said inspector is neglectful ofhis duties or that he is incompetent to perform the duties of theoffice,for any cause that existed previous to his appointment or thathas arisen since his appointment, or that he is guilty of malfeasancein office, the court shall certify the same to (he Governor of theCommonwealth, who shall declare the office of iuspeetor for the districtvacant and proceed, in compliance with the provisions of this act,the office.to appoint a properly qualified person to fillThe cost of said investigation shall be borne by the removed inspector;but if the allegations in the petition are not sustained thecosts shallbe paid by the petitioners.Section 14. The maps and plans of the mines and the recordsthereof, together with all the papers relating thereto, shall be keptby the inspector, properly arranged and preserved, in a convenientplace in the district for which each inspector has been appointed,and shall be transferred by him with any other property of the Commonwealththat may be in his possession, to his successor in office.Section 15.The persons who, at the time this act goes into GiTect,are acting as inspectors of mines under the acts hereby repealed shallcontinue to act in the same manner as if they had been appointedunder this act, and until the term for which they were appointedhas expired.ARTICLE III.Surveys, Maps and Plans.Section 1. The owner, operator or superintendent of every coalmine or colliery shall make, or cause to be made, an accurate map orplan of the workings or excavations of such coal mine or colliery, ona scale of one hundred feet to the inch, which map or plan shall exhibitthe workings or excavations in each and every seam of coaland the tunnels and i)assiiges connecting with such workings or excavations.It shall state in degrees the general inclination of thestrata with any material deflection therein in said workings or excavations,and shall also state the tidal elevations of the bottom ofeach and every shaft, slope, tunnel and gangway, and of any otherpoint in the mine or on the surface where siu-h elevation sliall bedeemed necessary by the inspector.
