In case of accident to the hoisting machinery at themain shaft the men at work in the Dunmore No. 2 vein can haveagress from the mine, during the time the w^ork is in progress ofconnecting the said No. 2 vein with the surface by means of thesecond outlet proposed, by the iron ladder from the said No. 2 veinto the Clark vein and thence to the surface by means of a rope andbucket, during the continuance of the repairs to the carriage andbuntings in the second opening from the Clark vein to the surface,or at the completion thereof by means of the carriag'e, both saidbucket and carriage being operated by separate boilers and an engine,and in case of necssity for the use of the said bucket or cai'riagesteam can be gotten up to hoist the same in an hour."Thirteen. During the progress of the repairs to the buntings andcarriage in the said second outlet or shaft, a hand windlass to raiseand lower the bucket has been provided in adidtion to the steampower used for said purpose."Fourteen. It is proposed in place of the bucket, as at presentpro^ided in the second outlet or shaft, to repair the buntings andreplace the carriage, w^ith safety catches, bridle chains and handrails, and to keep the boiler and engine in such condition as to generatesteam in an hour, so as to hoist and lower such carriage."Fifteen. The natural ventilation in said Richmond No. 3 mineis such, that, even when the fan is not running, men could stay at thefoot of the second outlet or shaft in the Clark vein for a month withsafety", so far as the supply of fresh air is concerned."Sixteen. During the past year but 10,000 tons of coal were producedat Richmond mine No. 3 and the total number of men employedin said mine does not exceed twenty-eight."Seventeen. The keeping up of steam in the boilers used to hoistand lower the bucket or carriage in the second outlet or shaft fromthe Clark vein to the surface would necessitate the employment oftwo additional engineers, one for day shift and one for night shift,besides the other extra expenses connected therewith, w^ould entailan extra expense of from eight to ten dollars per day upon the defendantcomj)any, and the not keeping up of steam constantly hasnot heretofore at the times when said second outlet or shaft hasbeen required to be used, prevented the getting out of the employessafely."Eighteen. The employing of no more than tw-enty men at onetime in Dunmore No. 2 vein, part of whom were engaged in open-
