The copies of the maps or plans of the several coal minesof each district as hereinbefore required to be furnished to themine inspector shall remain in the care of the inspector of the districtin which the said mines are situated, as official records, to betransferred by him to his successor in office; but it is provided thatin no case shall au}-of the operator or his agent.Section 4.copy of the same be made without the consentIf any superintendent or operator of mines shall neglector fail to furnish to the mine inspector any copies of maps or plansas hereinbefore required by this act, or if the mine inspector shallbelieve that any map or plan of any coal mine made or furnished inpursuance of the provisions of this act is materially inaccurate orimperfect, then, in either case, the mine inspector is hereby authorizedto cause a correct survey and map or plan of said coal mineto be made at the expense of the operator thereof, the cost of whichshall be recoverable from said operator as other debts are recoverableby law: Provided, however. That if the map or plan which maybe claimed by the mine inspector to be inaccurate shall prove to becorrect, then the Commonwealth shall be liable for the expense incurredby the mine inspector in causing to be made said test surveyand map, and the cost thereof, ascertained by the Auditor General byproper vouchers and satisfactory proof, shall be paid by the StateTreasurer upon warrants which the said Auditor General is herebydirected to draw for the same.ARTICLE II.Section 1. It shall not be lawful for the operator, superintendent< 1- mine foreman of any bituminous coal mine to employ more thantwenty persons within said coal mine, or permit more than twentypersons to be eni])]oyed therein at any one time unless they are incommunication with at least two available openings to the surfacefrom each seam or stratum of coal worked in such mine, exclusive ofthe furnace upcast shaft or slope: But provided, That in any mineoperated by shaft or slope and ventilated by a fan, if the air shaftshall be divided into two compartments, one of them may be used foran air-w^ay and the other for the purpose of egress and ingress fromand into said mine by the persons therein employed and the sameshall be considered a compliance with the provisions of this sectionhereinbefore set forth. And there shall be cut out or around theside of every hoisting shaft, or driven through the solid strata at thebottom thereof, a traveling way not less than five feet high andthree feet wnde to enable persons to pass the shaft in going from oneside of it to the other without passing over or under the cage or otherhoisting apparatus.9
