Doc.defendant, is a corporation <strong>org</strong>anized under tlie laws of the State ofPennsylvania for the purpose of mining and preparing for market andselling anthracite coal; that William H. Kichmond is its presidentand treasurer, and Alexander Waddell, superintendent and in chargeof its mines; that one of its mines, known as Kichmond NumberThree is situate in the First ward of the city of Scranton, in saidcounty of Lackawanna, just off of Parker street, and within the firstinspection district of the anthracite coal fields, that is to say, in thecounty of Lackawanna and lying northeast of East and West Marketstreets, in the city of Scranton;for several months last past.that the same has been in operation"Third. That it is provided by section 1 of article 4, of the act ofAssembly of the Commonwealth of Pennsylvania, approved the secondday of June, 1891, entitled 'An act to provide for the health andsafety of persons employed in and about the anthracite coal minesof Pennsylvania, and for the protection and preservation of propertyconnected therewith,' as follows:"Section 1. It shall not be lawful for the owner, operator or su- Iemploy any person or persons in suchpcrintendeut of any mine tomine, or permit any person or persons to be in such mine for thepurpose of working therein unless they are in connection with everyseam or stratum of coal, and from every lift thereof worked in suchmine not less than two openings or outlets separated by a strata ofnot less than sixty (GO) feet in breadth under ground and one hundredand fifty (15Uj feet in breadth at the surface, at which openings oroutlets safe and distinct means of ingress and egress are at all timesavailable for the person or persons employed inthe said mine, butit shall not be necessary for the said two openings to belong to thesame mine if the persons employed therein have safe, ready and availablemeans of ingress and egress by not less than two openings.This section shall not apply to opening a new mine or to openingany new lift of a mine while being worked for the purpose of makingcommunications between said two outlets so long as not more thantwenty persons are employed at any one time in such mine or newlift of a mine, neither shall it apply to any mine or part of a mine inwhich the second outlet has been rendered unavailable by reason ofthe final robbing of pillars previous to abandonment so long as notmore than twenty persons are employed therein at any one time.The cage or cages, and other means of egress shall at all times beavailable for the persons employed where there is no second outlet."And also by section .3 of said article 4 of said act of Assembly itis provided as follows:"Section 3. The escapomonts, shafts or slopes shall be fitted withsafe and available ai)i)linnces by which the persons employed in themine may readily escape in case an accident occurs, deranging thehoisting machinery at the main outlet."
