Doc.imdei' the law creating the same and not by any consideration ofpersonal favor; that we will certify all whom we may find qualifiedand none others."Section 2. The examining board shall examine any person applyingthereto as to his competency and qualifications to discharge theduties of mine foreman or fire boss.Applicants for mine foreman or fire boss certificates shall be atleast twenty-three years of age, and shall have had at least five years'practical experience, after fifteen years of age, as miners, superintendentat or inside of the bituminous mines of Pennsylvania and shallbe citizens of this Commonwealth and men of good moral characterand of known temperate habits.The said board shall be empowered to grant certificates of competencyof two grades, namely: certificates of first grade, to personswho have had experience in mines generating explosive gases andwho shall have the necessary qualifications to fulfil the duties ofmine foreman in such mines; and certificates of second grade, to personswho give satisfactory evidence of their ability toforeman in mines not generating explosive gases.act as mineSection 3. The said board of examiners shall meet at the call ofthe mine inspector and shall grant certificates to all persons whoseexamination shall disclose their fitness for the duties of mine foreman as above classified, or fire boss, and such certificates shall besufficient evidence of the holder's competency for the duties of saidpo!?ition so far as relates to the purposes of this act: Provided, Thatall persons holding certificates of competency granted under theprovisions of the act to which this is a supplement shall continue toact under this act: And provided further, That any person acting asmine foreman upon a certificate of service under the act to whichthis is a supplement may continue to act in the same capacity at anymine where the general conditions affecting the health and safetyof the persons employed do not differ materially from those at themine in which he was acting when said certificate was granted:Provided, however. That if such a mine foreman leaves his presentemployer and secures employment elsewhere at any mine where inthe judgment of the mine inspector of the district the conditions affectingthe health and safety of the persons employed do differ materiallyfrom those at the mine at which he was employed when hiscertificate was granted, it shall then be the duty of the mine inspectorof the district in which he has secured employment to servewritten protest against such mine foreman's employment to theoperator of said mine.Section 4.
