No. 11. MINING LAWS OF PENNSYLVANIA. clxviiunder him, or iu the mines under his charge and supervisionas a miner, who does not hold such certificates. Any personor persons who shall violate or fail to comply withthe provisions of this act, shall be guilty of a misdemeanor,and on conviction thereof shall be sentenced to pay a fine not lessthan one hundred dollars and not to exceed five hundred dollars, orshall undergo imprisonment for a term not less than thirty days andnot to exceed six months, or either, or both, at the discretion ofthe court.Section 7.The persons who are now serving as members of theMiners' Examining Board as created by the act approved the ninthday of May, Anno Domini one thousand eight hundred and eightynine,entitled "An act to provide for the examination of miners inthe anthracite region of this Commonwealth, and to prevent theemployment of incompetent persons as miners in anthracite coalmines," shall continue under the provisions of this act to serve asmembers of the ''Miners' Examining Board" until the terms forwhich they were appointed under the provisions of the said act approvedthe ninth day of May, Anno Domini one thousand eight hundredand eighty-nine, shall have expired, and in the performanceof the duties of their office they shall be subject to the provisions andrequirements of this act.Section 8. Nothing in this act shall be construed to in any way,excepting as herein provided, effect miners' certificates which havebeen lawfully issued under the provisions of the herein mentionedact, approved the ninth day of May, Anno Domini one thousand eighthundred and eighty-nine.Section 9. It shall be the duty of the several Miners' ExaminingBoards to investigate all complaints or charges of non compliance or"vjolation of the provisions of this act, and to prosecute all persons sooffending; and upon their failure so to do, then itduty of the districtshall become theattorney of the county wherein the complaintsor charges are made to investigate the same and prosecute all personsso offending, and it shall at all times be the duty of the districtattorney to prosecute such members of the Miners' Examining Boardas have failed to perform their duty under the provisions of thisact; but nothing herein contained shall prevent any citizen, a residentof this Commonwealth, from prosecuting any person or persons violatingthis act, with power to employ private counsel to assist in theprosecution of the same; upon conviction of any member of theMiners' Examining Board for any violation of this act, in additionto the penalties herein provided, his office shallbe declared vacant,and he shall be deemed ineligible to act as a member of the saidboard.
