GENERAL TERMS AND CONDITIONS OF TENDER & CONTRACTBidders should read these conditions carefully and comply strictly while sending theirbids.DefinitionsFor the purpose of clarity, the following words and expressions shall have the meaningshereby assigned to them: -a) “Contract” means the Agreement entered into between the Purchaser and thesuccessful/ selected bidder, together with the Contract Documents referred totherein, including all attachments, appendices, and all documents incorporated byreference therein.b) “Contract Documents” means the documents listed in the Agreement, including anyamendments thereto.c) “Contract Price” means the price payable to the successful/ selected bidder asspecified in the Agreement, subject to such additions and adjustments thereto ordeductions there from, as may be made pursuant to the Contract.d) “Day” means a calendar day.e) “Delivery” means the transfer of the Goods from the successful/ selected bidder tothe Purchaser in accordance with the terms and conditions set forth in the Contract.f) “Completion” means the fulfilment of the related services by the successful/selected bidder in accordance with the terms and conditions set forth in theContract.g) “Goods” means all of the commodities, raw material, machinery and equipment,and/or other materials that the successful/ selected bidder is required to supply tothe Purchaser under the Contract.h) “Purchaser” means the entity purchasing the Goods and related services, asspecified in the bidding document.i) “Related Services” means the services incidental to the supply of the goods, suchas insurance, installation, training and initial maintenance and other similarobligations of the successful/ selected bidder under the Contract.j) “Subcontractor” means any natural person, private or government entity, or acombination of the above, including its legal successors or permitted assigns, toSeal & Signature of the Auth.
