RISL: RFP FOR SETTING UP OF VIDEO CONFERENCE SOLUTION IN RAJASTHAN (BEFORE PRE-BID)23-Aug-13under the Contract is terminated, and the date upon which such terminationbecomes effective.ii. Depending on merits of the case the supplier/ selected bidder may beappropriately compensated on mutually agreed terms for the loss incurred bythe contract if any due to such termination.iii. The Goods that are complete and ready for shipment within twenty-eight (28)days after the supplier’s/ selected bidder’s receipt of the Notice of terminationshall be accepted by the Purchaser at the Contract terms and prices. For theremaining Goods, the Purchaser may elect:a. To have any portion completed and delivered at the Contract terms andprices; and/orb. To cancel the remainder and pay to the supplier/ selected bidder an agreedamount for partially completed Goods and Related Services and for materialsand parts previously procured by the supplier/ selected bidder.6.29. Settlement of Disputesa) General: If any dispute arises between the supplier/ selected bidder and RISLduring the execution of a contract that should be amicably settled by mutualdiscussions. However, if the dispute is not settled by mutual discussions, a writtenrepresentation will be obtained from the supplier/ selected bidder on the points ofdispute. The representation so received shall be examined by the concernedProcurement Committee which sanctioned the tender. The Procurement Committeemay take legal advice of a counsel and then examine the representation. Thesupplier/ selected bidder will also be given an opportunity of being heard. TheCommittee will take a decision on the representation and convey it in writing to thesupplier/ selected bidder.b) Standing Committee for Settlement of Disputes: If a question, difference orobjection arises in connection with or out of the contract/ agreement or the meaningof operation of any part, thereof or the rights, duties or liabilities of either party havenot been settled by mutual discussions or the decision of tender sanctioningProcurement Committee, it shall be referred to the empowered standing committeeSeal & Signature of the Auth.
